Even though I'm not a citizen of the USA it is my opinion that the seal should be restricted to OFFICIAL government business.

I didn't know that, and I wouldn't have thought twice about seeing it in gift shops. I have a nifty little magnet with a mini Declaration of Independence on one side and a mini Bill of Rights on the flip side, that I got as a momento from visiting the National Archives.

I miss the days when shiat like this would have been what people talked about for a week.

Selling presidential tees from the Grope-A-Cabana,  now that's much sleazier than presidential seals on a mug in a White House gift shop, but...y'know. Nothing matters anymore.

To my knowledge there are only a couple of exceptions to the use of presidential seal outside of whitehouse, documents, and vehicles associated withe the office of the president, and those literally took an act of congress to get.  Those being Disney's Hall of Presidents.

I think trump didn't sever his connections between his businesses and himself.  that makes him responsible for the mistakes of his private business corporation while in office.

When I was younger,  I received an academic reward with the presidential seal embossed upon it, signed by Bush the first. If I were to receive something in the mail today with that seal on it, it would land in the junk pile.

right now, trump's biggest legal issue is the stormy daniels case....but that's only for the moment.  there's the open possibility of a messy white house divorce in the offing, and of course Mueller waiting in the wings.

so you're probably right in saying that selling white house/trump stuff plastered with the seal of the president is not worth bothering about.  esp not when you consider what's already in the pipeline and heading right for Donny's head.

The statute regulating (not "barring" or "prohibiting") use of the presidential seal is drafted with care. Under Section 713, one commits a crime only by displaying the seal "in a manner reasonably calculated to convey, a false impression of sponsorship or approval by the Government of the United States or by any department, agency, or instrumentality thereof."

It comes down to whether someone would presume the head of government of the United States selling merchandise creates a "false impression of sponsorship or approval by the Government of the United States."
