A university games department is acting as if its mission is the one the whole school should care about;  It finds support from administration, alumni, and the meatheaded portion of students. Now here's Tom with the weather.

University lawyer
That lawyers also argue that the university taking a long time to discipline the attacker and not following its own rules for handling sexual assault accusations is not proof that the university was "deliberately indifferent" to Title IX requirements

Plaintiff's lawyers
"Not so fast, the woman's lawyers say.
They argue she "suffered from flashbacks, nightmares, hypervigilance, depression, that she was floundering, her grades were suffering, she could not sleep, and that she lived in fear of seeing not only her attacker but his friends as well, and thus became withdrawn."

Laughing stocks, both sets of lawyers.

Every teacher and administrator should be fired, every student should be expelled, and bulldoze the entire university.

a female student who says she was sexually assaulted by former MSU football player Keith Mumphery in 2015

Those two magic words mean he's basically untouchable.

WSU isn't Michigan State, but you get the idea.  Colleges would rather lose a hundred regular students than a single football player.

I you're not sports you're little people.

This is puzzling.

As a man who gets squicky when I have to grab a fly swatter, I never realized just how easy it has been to harm other humans.

Be not glad. Now that I have cast my perilous gaze upon you, the result may not match what you had wished.

In this case there was no conviction of the alleged perpetrator; prosecutors though they would not prevail in court and never brought charges.

The self-described victim could sue him civilly. File a restraining order.

If I'm reading this correctly it's almost as if Universities are expected under Title IX to be a third court-- beyond criminal and civil court. IIRC there was an Obama order to apply preponderance of evidence standards, rather than reasonable doubt, to alleged sex crimes on campus in these star chamber investigations that can occur.

The only reason I can think of to sue the college for not preventing a legally innocent person from entering campus is because the college has deeper pockets.

Mumphery, who never was charged in criminal court because prosecutors could not prove their case beyond a reasonable doubt
**

Not just "could not prove", but how about "never even tried to prove", which implies that there was zero evidence.

Nassar's guilt doesn't mean we abandon the rule of law and dismiss a right to a fair trial for others accused.

There are tons of examples of people proven lying about being sexually assaulted on campus. Sexual assault is a serious crime and should be treated like such. Not handed off to kangaroo title ix campus proceedings who have over and over shown an extreme bias against the accused, because otherwise they can't justify their budget. "One in three"? Liars. "One in five"? Liars. More like one in one hundred, or one in two hundred. Until they start acting seriously, they belittle every legitimate assault victim.

Any assault is too many, and if guilty, severe jail time. But not based on no evidence.

Having attended three large universities and worked for each as well as several others after the PhD, I can testify that universities are just another version of the mega-corporate entity that wants all the cash and none of the responsibility.

Ahem.

This is not a reasonable response. Jane and Joe Schmoe, getting their chemical engineering degrees, having never seen the inside of a stadium, should not need to suffer because the top admins are corrupt.

I'm not sure of the logistics, but is it possible to light Penn State on fire and then use it to light MSU on fire?

It seems to me that this would be an efficient use of time and resources. Win-win?

No, no, no, don't you see? Everyone who is, or ever was, at that university needs to be blamed. We also need to set aside all our silly laws about due process in sexual assault claims and simply lynch anyone accused of sexual assault immediately, that day. Anything less is proof that you are, in fact, for sexual assault.

It's unfortunate given the school's track record for ignoring issues, BUT her case was not proven in court.  They could just as easily be sued by him for trying to keep him off campus without good reason.  She should have gotten a better lawyer... or tried for an enforceable restraining order... or anything other than just whining to the school.  She doesn't have anything legally to back up her complaint.

I'm not saying he didn't commit the crime.  But he was not convicted of it... therefore he is considered innocent.  You can't ban someone based on accusations only.

or anything else, for that matter.

This is why I've been saying all along that we need to stop treating universities that put so much into their athletic programs like regular schools. Just transform them into sports academies and separate the actual academic and artistic pursuits to actual universities. Keep the jocks out of the regular academic system and remove their requirement to attend classes, and allow the people who want to go to school to learn something to do so without having everything undercut and shoved aside for sports.

Send the jocks to jock school, and let everyone else have a school where there's no administrative bias toward the athletic programs.

MSU not liable for distress caused by letting sex assault attacker back on campus

I don't think Michigan State should be nuked, but at this point, we need to have a serious discussion about nuking the NCAA. From Michigan State & Penn State to rape cover-ups at Baylor to academic fraud at UNC to real fraud at Auburn, every institution has gone virtually unpunished. Yes, I know Penn State was slapped on the wrist, but that's about it.

The NCAA cannot & will not police itself. It's become too big to fail. As a result, corruption has run amok. If we didn't have an administration that was every bit as corrupt as the NCAA, I'd say a full-scale investigation & sanctions by the Department of Education would be necessary. That will have to be for a smarter, saner presidency though.

What she had to endure was awful.

Not to minimize that, her problems seeing her attacker friends are her problem, not the university's.  I hope she has a great therapist, and that she prevails in her lawsuit, but, she can't expect MSU to control her attackers' friends.

Yeah, and I never understood that. If I give you a ring, it's yours. You can wear it, toss it in a drawer, sell it, trade it for tattoos, whatever. It's yours. How the hell is it different than trading a TV?

Yes, yes, you are correct.  Burn MSU to the ground.  Expel my daughter who works 3 jobs to attend, and then salt the earth that MSU once stood on.  Great idea.  Did I mention she has a 3.85 GPA?  Or that she has been to a total of 2 football games in 3 years?  Yeah burn it all down.  While I don't disagree with the death penalty for all sports, it would be a shame for the Broad Art Museum to be destroyed by flames.  Or for my daughter to be forced to Ann Arbor......
