Sending the right message to "kids"  is more important than the first amendment, or even the truth.  And by the right message I of course mean the message of the right.

Here's the oath they take

As an officer of the Court serving in the administration of justice, I will:
Support the Constitution of the United States
and of the State of Iowa
Perform to the utmost of my abilities and education
Maintain the respect due to the Courts and my colleagues
Faithfully and ethically discharge the duties required of Iowa lawyers


Something's not right.  They should pay for this mischief out of their own pockets.

Man, did they even talk to an attorney before acting?  It would have been easy to kill these shirts. All you would have to do is eliminate the right for any student groups to use the school's trademarks.  Easy peasie.  What you cannot do is is to target specific messages to deny trademark use.  That is how you get lawsuits.

So, you think cases should be decided...before the case is decided? Because that's how you determine what falls under First Amendment.

There have been hundreds of "exceptions" made to the public's rights, mostly under the name of "protecting" us from drugs, and more recently, terrorism. The Iowa State case wasn't an open-and-shut case for that very reason.

No.  It was covered towards the end of the article.  Because the group was an recognized student society they had the rights to use the image just like all the other student clubs at the school do.

Good.

I'm kinda old. I started college in 1977. Back then, universities treated you like an adult. Blow off class? They didn't care. If you passed, great, and if you failed, even better. Your problem, not theirs. T-shirts then said all kinds of things. Freedom of expression was a big part of the entire university climate.

Now they try to run it like a high school and control everything. And you wonder why we have so many snowflakes.

Stupid of the university, but I can see why they did it. Republicans in state legislatures have repeatedly shown that they get raging erections from punishing "the libs" at state universities. Teaching a class, or even a single text, that a religious conservative doesn't like? Republican lawmakers will try to take away university funding or independence. A pot leaf with the IU logo is a great target for them.

University should have stood up for its students, but I guess they're running scared.

My NORML shirt is 100% cotton, american made.  I got snippy with the state director by email and he called me out for not being a member so I joined up and he reluctantly gave me the shirt.  We learned to only talk after coffee that day.

Of course the university could have revoked the license for student organizations to use their copyright and trademark. It's not about stopping them from wearing anything, it's about preventing them from using your intellectual property in their own commercial products (ie shirts they are selling).
