So the prosecuting attorney says the judge made legal errors and the defense attorney says he got it right.  Go figure.

Don't blame the judge, blame the Crown for not proving a lack of consent beyond reasonable doubt.  And pay attention to the words "reluctant acquittal."  Sounds like the judge absolutely hated to acquit the asshole.

I hope the rapist dies an agonizing death.

In the States, they declined to charge me for assault for knocking the absolute tar out of a guy who was yanking his pants down to violate a woman who had passed out in his car. So, go Massachusetts I guess. Also, I can confirm that striking a man in the face with a closed fist is rarely a good idea, but it IS often hilarious. Dragging him with his pants down a gravly alley to cops who are taking one of his friends away is even MOAR hilarious, especially with said friends watching.

Consent isn't just a technicality, kids. If she can't tell you "go for it, you stud" then maybe you should just keep your hands to yourself and your pants on.

They'll consider the legal merits of the case and the legal arguments, along with their own knowledge and research, then mail a decision in a couple weeks.

It means the cabbie got a better lawyer than the crown and that's insufficient grounds for an appeal unless the crown prosecutor was actually legally negligent or incompetent. That's why the argument of, "Evidence? She was drunk, what more evidence do you need?" isn't really a good argument to take to appeals.

And the real reason is in the Post is because of the optics of "Middle Eastern immigrant rapes Canadian"...

If this province or if Canada nationally has laws that govern the nature of consent while intoxicated then the judge made an error in allowing that kind of defense in the first place. Whoever sat in-judgement should have weighed the state that the victim was found-in, with the amount of time that the victim was in the presence of the defendant.

The article cites eleven minutes between him picking her up and her being found post-sexual-contact. While it is not impossible, I find it highly unlikely that a driver could convince a fare to have sex in eleven minutes.

I went to high school in Maine. I'm fair acquainted with our Neighbors to the North in Nova Scotia. There's certainly sections of Maine that are populated by EXACTLY the same folks, though in fairness, perhaps with a few MOAR methheads.

If the judge had been sure she was passed out the whole time, the taxi driver would have been convicted. The judge is entertaining the possibility that there was a time when she was conscious and able to consent, did so, and that as soon as she became unconscious, the driver stopped the sexual activity.
In my view, highly unlikely, given the time frame this all occurred in.

From the sound of it, the cabbie said she consented and she didn't testify otherwise, the prosecution relying entirely on the fact that she had been drinking (not necessarily unconscious at the time). The judge apparently had a doubt about whether she was SO drunk that she was unable to consent.

Most of you FARKs aren't going to read that CBC link.   Let me summarize it:

1.  Ghomeshi was found not guilty because he had documentary evidence of consent for each and every false accusation.  Text messages, telephone recordings, sex tapes, etc.

2. Bill C-51 will prevent defendants from using that kind of evidence under the same special "rape shield" exceptions that prevent the admission of any evidence that makes women look bad.  Prior false accusations, mental health records, history of promiscuity, etc.

3. The defendant is compelled to participate in his prosecution.

Canada is a failed state because it departs from fundamental justice and the common law.

I've talked to and worked with a few women who've worked with him, and the vibe on stage is one thing, and watching them recoil from his presence backstage and in the Green Room tells me a lot about his operating principle. Including the acts that he's "helping promote for the label." THOSE girls...they made a decision to accept his help, but at least they were adults entering into that Devil's Bargain.

All the regular taxis in my city have cameras these days, mainly as a deterrent to robbery.  And presumably so they have evidence you puked in their taxi when they come after you for the fine.

I would never get an Uber/Lyft or independent taxi.  If you're such a scuzzball you can't or won't get a job as a contractor for one of the companies, I don't want to be in your car.

That's exactly what they claim. What happens is an entirely different story. With literally the band's manager trying to hide the fact that my two underage runners were getting whisked off to the bus. They were my employees. I know their folks. I promised to look out for them when they came to work at the club. Sorry if that bursts your bubble, but Jian is a world class prick. It's not about feelings, it's about their date of birth on their I-9 and driver's licenses.

The girls were of age, things would have been a bit different. One of my crew decided to become a stripper after she left, and in fact she did some porn a few years later. And we talked about it, and she had a good plan, she actually DID put herself through school, and she kept away from drugs, and she went on to get her Masters. And has a pretty good life now. You seem to be under the impression that having sex makes a woman a slut, which is a strange position to start from. Sex isn't the problem. It's the predatory nature that Jian relates to women in.

You seem to be of the opinion that I'm talking about OTHER cases that's Ghomeshi's been involved in. I'm talking about something that is NOT a case, because we stopped it. Before it could even BE a thing. And that his manger tried to run interference to get those girls ON the bus is why I say he's a Gottverdammt creeper. Not a hypothetical bus, but the bus that was literally right in front of me. And involving my employees. My underage employees.

I'm not talking about hypotheticals, but people I've worked with over the years. And that includes some of the artists that Jian has "mentored" over the years as well. He's a creep. It's not exactly an unknown factor in the industry. Not as much as Harvey, but he's not someone you let near people you care about.
