Everyone is entitled to a Defense in our Criminal Justice System, like it or not. It's what makes us American. We may put our hearts before our heads, but we cannot forget this statement, no matter how guilty he may look. "Innocent until proven guilty."

I'm proud to be an American, No sarcasm. Because if he is guilty, then hopefully he will be found guilty, and then Justice will be served my friends, and we will be in the eyes of righteousness.

Oh, I think these 19 year olds know what the justice system is all about. I worked at a school for Juvenile delinquents and the one thing they used to all agree on was this:

"If you want a lawya' that will talk dog, you gotta pay for him. Them public lawyers, they don't talk. The prosecuter, he talks. The judge talks. But your lawyer, he don't talk. If you don't want to go to jail then you need to pay for your lawyer."

And most of the kids I delt with probably had more court time than Allan Dershowitz. Most states spend like 10 times as much prosecuting a case as they do on defending it. We all found out how much of a differance money makes in the O.J. case. Don't matter how much evidence they have against you, if you pay the muder tax you go free.

Harmonia: "Everyone" should changed to "every American citizen". Military tribunals are being used for non-citizens, therefore general rules of criminal proceedure do not apply, at least that is my understanding.

So, is that guy John Walker not going to go before a tribunal? He is an American citizen, at the moment, and was a member of the Taliban. If we read about this happening China, North Korea, Libia or some such captures an group of Americans and puts them on trial before a military tribunal? Will they expect them to get a fair trial when the judge, prosecutor and their defender are all memebers of the same military and are chosen by the same people?

I think too many people confuse the "right to a fair trial" with trying to get a scumbag off. It's the job of the attorney to ensure the correct procedures are followed, not to claim their guilty client is innocent. If he's guilty he should be executed. THAT'S fair.

I think a client has a right to a lawyer who will try to get him off, even if the lawyer knows he's guilty. Although it's totally legal, that doensn't mean that they're not empty-souled dirtbags.
