The current rules of engagement, as I understand them, allow for immediate action in such a circumstance. If someone is shooting at you, and you can see them; they are an enemy combatant, regardless of other factors.

/ but, I have been known to be wrong in the past. Perhaps, someone around can shed more light on the subject?

This. It's like the dress code at a entry level job: If you have to ask yourself if this is OK to wear, don't wear it.

Of course that's contingent on the subject having enough self-awareness to even question themselves.

I'm going out on a limb here but I doubt people fighting in active war zones like Syria care if their actions result in the UN writing a strongly worded letter.

you can shoot at them when they're in the planes, you can shoot at them when they're on the ground, but when they're floating down eyeing you with murderous intent, they've essentially called a timeout...?

The Geneva Convention allows for shooting at paratroopers:

Article 42 - Occupants of aircraft
1. No person parachuting from an aircraft in distress shall be made the object of attack during his descent.
2. Upon reaching the ground in territory controlled by an adverse Party, a person who has parachuted from an aircraft in distress shall be given an opportunity to surrender before being made the object of attack, unless it is apparent that he is engaging in a hostile act.
3. Airborne troops are not protected by this Article.

Depends on which religion we're applying to it and which one we're trying to suppress. The rules vary.
