You don't have to prove actual malice in a libel case involving a private citizen. That standard's only for public figures, which this Saudi kid definitely wasn't/isn't. I'm just surprised Beck's insurance company hasn't already settled; the plaintiff's lawyer must smell mega-verdict.

He should widen the case, it wasn't just Glenn Beck.  During the initial hours, names were flying everywhere - and articles were being released with those names because everyone was trying to get 'the scoop'.  They later edited out the names, and blamed social media.

Anyone get the feeling someone might be trying to distract the public away from something that he may or may not have done in 1990? Maybe the fact that he has never, ever responded to rumors that he raped and murdered a girl. Never once given a convincing alibi. Never offered to take a lie detector. Never even agreed to sit down with investigators.

Seems awfully suspicious to me.

malice is a term of art.  it's not precisely a psychological determination, it's a word used that has a legal description.  generally, malice in the defamation context can be shown by knowingly false statements, or statements made with a reckless disregard for the truth.

the reason they allege 'with malice' is because that's a requirement to overcome 1st amendment protections, because this arises out of a public concern/issue.
