Really, this is an example of government tyranny trampling all over our freedoms and liberties. What right does a government have to FORCE a mall to allow people to speak on its premises? you may be right. roseville is a very, very white city. i doubt that this rule was enforced evenly among the shopping population.

I can ask "Want to have anal sex while the Orange Julius manager films us" but not "are you choking?"

I actually kind of LIKE this rule. It presents an interesting atmosphere for conversation. Strange how my mind goes perverse when these rules are in place.

I live down the street from the mall that originally established precedent in CA by trying a similar rule. Link

The rule in CA is that public-access shopping centers are considered public areas in terms of CA constitutional free speech, subject only to reasonable rules and regs by the shopping center owners. The case also established that CA constitution can grant additional rights the US one doesn't.

The downside is navigating the mass of charity collectors (i.e. panhandlers w/ a trademark) outside all the strip malls, but I'd rather err on the side of free speech.

There's a mall in Alliance, OH that bars groups of more than 4. Yes this includes families. Mom, dad & 3 kids... Someone is sitting by themselves.
The miserable, kitten strangling witch that works the info desk is a stuck-up old busy-body that thinks the mall belongs to her and is constantly telling security how to do their job & to remove people that might rub her the wrong way or otherwise offend her sensibilities.

Did the Huff-Po deliberately bend the truth on this story? The people involved were VOLUNTARILY engaging in a discussion with each other. The mall rule was that one could only engage in talk about the mall.

From the Sacramento Bee: "The specific rule at issue prohibits a person in the center's common areas from "approaching patrons with whom he or she was not previously acquainted for the purpose of communicating with them on a topic unrelated to the business interests" of the mall or its tenants. "

There is a supermarket here that is set up so you go in through one entry and have to trawl through the whole place (big, 10 minute walk) in order to get to the checkouts.

You want a bag of sweets from the display by the checkouts? Then just walk through the ample room at the checkouts (which you walk past to get to the entry) to the display and back to the checkout to pay right?

No. The ubersturmbahnfuhrer of the checkouts will run (actually run) across the shop to stand in front of you with her arm out and hand in your face and shout 'Sir, you CANNOT come through this way!'

She will then get very angry when you just cannot stop laughing at the popmous look on her screwed up little nazi face. She wont tell you to leave the store because you havent actually done anything or even spoken to her (and she is just a supervisor so knows the managers wouldnt back her up anyway), but she will look like she wants to kill you as tear actually run down your face from laughing.

Actually I think she got fired/moved because it hasnt happened the last couple of times Ive been there.

I'm not sure if you're being serious.

The Supreme Court decided three decades ago that states can decide on their own how "public" public-access areas like shopping malls are. California's definition was at the heart of that decision (Pruneyard).

If you don't like someone talking to you, walk away. Unfortunately you do not have a right to "not be annoyed."

Has this mall never heard of Pruneyard Shopping Center v. Robins (^)? The case is nearly identical, and Pruneyard lost at the Supreme Court. Why on earth is this mall considering wasting more money to appeal, when there's clear precedent that they will lose?

My mall must be well policed then. I never get the religous freaks. But then, I maybe go to the mall 7 times a year. Darn you Hallmark Christmas ornaments.

However, my local mall is stuffed to the gills with the kiosk venders who won't leave you alone. I've actually been physically grabbed by some French dude (or a guy with a good French accent) selling some nasty perfume and makeup. Cue the jokes about my appearance. But the dude would not take no for an answer, or release my arm.

After I managed to get away without hitting him for not letting go of my arm, he moved on to two tiny Asian women walking by. Talking rapid-fire about his make-up, he grabbed the arm of one of them, while the woman was faintly saying no, no, thank you, no. It was Indo-China all over again.

\Cool story sis.
\\ Yes, I know I should have reported him, but the security office at the mall seems to always be closed, hence my not going so often.

What I find amusing is that they are spending money fighting stupid things like this while they have a mall in Downtown Sacramento (about 20 miles away from the mall in the article) that is owned by the same company and is a ghost town because they haven't done anything with it in years.... I could see the lawsuit money being better spent but I guess that's just me.

I've been to this mall so I'm really getting a kick. They had a bunch of rules posted outside...I believe no swearing was one of them. I'm surprised no one has challenged that policy.

Yeah this has been a big problem in california (esp. socal) for awhile. I just tell them to fark off.

You don't just go to court and change the policy. You have to have standing. In other words, you have to have been punished by the rule and be interested in fighting the legal battle and paying fees associated with it. Most people in trouble for cussing at the mall are probably kids and their parents probably didn't care and had no interest in helping them challenge the rule. And those adults who may have been punished probably didn't care enough about it to take it to court.

It sounds harsh, but it's not really as bad as it sounds. It keeps disinterested parties from clogging the court system. If you don't have standing and want to get it, then go get arrested for violating the law you have a problem with and all of a sudden you will have standing to bring a constitutional challenge to the law.

I know that many have already indicated this, but this is an amazing idea. I wish someone had told me this back when I was in college. On college campuses, it seems like some yahoo is always trying to hand you a flyer for some event you don't care about or convert you to their religion. (It always makes me think of the Mitch Hedberg joke about flyers, which is something to the effect of, "When somebody hands me a flyer, they may as well just say to me, 'Here, go throw this away.'")

My one exception to my disdain of strangers approaching me to convert me is Mormon boys. They are so cute, with their dress shirts and ties and backpacks and bicycles. I probably only like them because they are such a pleasant contrast to the majority of approximately-21-year-old guys I encounter, who are horny borderline alcoholics.

I have a friend who is also atheist and would ALWAYS invite Mormons in if he had the time, if not he would make an appointment for them to come back. Then would make sure to smoke a bowl or two before they got there and then proceed to proceed to argue religion and fallacies in their pitch over a couple of beers. They would come back several times to talk to him, apparently a good time was had by all.

Some friends of mine and I pulled a great prank on some Jehovah's Witlesses. We had just gotten back from an SCA event and were all in garb, and were sitting around in one of the girls' apartment drinking when we saw the Witlesses working their way around the courtyard. So the chick who's apartment we were in (who was a wiccan and a bit of an exhibitionist), came up with a brilliant plan.

She got out a throw rug with a pentacle on it spread it out on the floor, stripped naked, and laid down on it. The rest of us stood in a circle around her holding swords and chanting nonsense. When the witlesses got to the door, one of the group invited them in and said "Oh, you want to talk about religion? We were just starting a ceremony, why don't you join us". They took one look in and took off running. It was priceless.
