I'm curious about the legal standard here. You often hear "ignorance of the law is no excuse" and that makes sense if you're trying to argue that, for instance, you knew stealing was wrong but thought that stealing from nuns was okay (bad example, I know). If, on the other hand, you're arrested for wearing an orange hat on a Thursday because some little podunk town has a law against it, I would think that ignorance was a pretty good excuse.

Ignorance of the law is no defense, but laws can't be unconstitutionally vague -- they have to give sufficient notice about what sorts of acts constitute crimes. It's not that he was unaware of the law; it's that the law was itself unaware of what it comprised.

"ignorance of the law is no excuse" is the worst excuse ever. Ask any judge or lawyer if he thinks ANYONE is capable of memorizing all the Federal, State, and Municipal code...it is ridiculous on the face of it. EVERYONE is ignorant of MOST of the law, including all judges and juries.

The State Supreme Court was right to throw out the charges if there is no law prohibiting showing a thong in public. However, I think charges for disorderly conduct or the like would apply.

Although I agree that the baring of your A$$ to a group of 13 year old girls is kinda sick.....but, you see thong clad A$$es all the time on a beach. So, are the police going to arrest everyone this summer who goes to the beach wearing thong swimwear? Personally, this guy deserves a MAJOR beating for doing this to 13 year old kids on a public road, but I can also understand that indecent exposure laws were not broken. Glad to see he is not getting off totally free though.

For everyone who says "ignorance of the law is no excuse" is a stupid copout for judges and the state, tell that to all the people in New York who are getting citations left and right for laws that no one had heard of, like sitting on a milk crate.

As far as this case is concerned, if the girls had not reacted as they did, telling their parents or cops (article does not say what they did), what would he have have done next? He may have been a child molester who was making his first moves.

This may now become standard operating procedure for child molesters on the prowel, since they now know they can not be arrested for flashing their underwear at little girls.

Anyone of you with a 13 year old kid, like me, how would you feel if this was your child? Wouldn't you want this perv to go to jail?

Women are much more discreet and coy in practicing their exhibitionist tendencies. Society does have a double standard based upon the method of exposure. Though it could be argued that the base desire is not too different.

It's all about environment. At certain locations, buttocks, boobies etc are de-sexualised up to a degree. That's why it's ok at beaches, and a woman baring her boobies or wearing a thong isn't a 'fark me now' signal.

If the dude went around with a thong on the beach, the cops wouldn't arrest him, at least not here. Bad taste is not a criminal offense, neither is coming off a rather gay.

But he didn't do it on a beach, and he wasn't just walking around doing normal things. He deliberately flashed his hairy ass at girls in front of a school.

Probably got some kind of sexual arousal from it, but there's no way we can tell. Perhaps he was just doing something he considered 'funny' - mooning the girls. There is way too little information in the article to make an accurate judgement - was it totally unprovoked etc? No way to tell.

I find the judge's decision to be rather idiotic though, as it would be obvious to 99% of the public that baring your buttocks in front of a school and some young girls is illegal.

OTOH, assuming that 13 year old girls are innocent little things that must be protected from all kinds of nudity is absurd. These days, (too) many girls are sexually active at that age. Your daughter might be.

Maybe it was just the people I hung around in my teens, but the girls around then would either overwhelm him with verbal abuse and ridicule or kick his ass. Or both. Not that I condone his behaviour; it's just too bad the girls dinnae kick his butt :).

I hope this thing gets noted somewhere, so that if in the future he does something more, the authorities will at least know it and may prove a pattern of 'disruptive' behaviour.

I think this judgement was right. It is not obvious if what he did was illegal or not.

How can you say that a 13 year old seeing you on a BEACH wearing a thong is not illegal, but seeting you in front of a SCHOOL wearing a thong is? And what if the school is near a beach and some kid sees you then?

And does it really make a difference if he had a trench coat on and suddenly revealed that all he was wearing was a thong, or whether he just walked around with the thong without a trenchcoat?

I also don't agree with people who say he's sick. He was in a thong. It was an ass. My freind mooned me once, it's no big deal seeing someone's ass. Hell, you can see people's asses on TV in Britain without any censoring can't you? Like there was a commercial with a naked guy running across a rugby course I think.

Laws against nutiy are stupid. I'm no exhibitionist myself, nor do I want to look at some guy's package, but being nude should be everyone's contitutional right. It seems to me to that a society which concerns itself with covering up it's natrual body is pretty primitive. We laugh at all the people from victorian eras wearing 10 layers of clothing in 90 degree weather. Well people 100 years from now are gonna laugh at us. I bet in 100 years it will be common for women to go topless in the summer just like men can.

In fact I wonder if any woman has ever tried to fight any regulation about that in court. I mean, if a woman DID go topless, and it's legal for MEN to do so... That's discrimination based on gender.

Of course women already get away with it to a very limited degree when breast feeding, or on a beach sometimes if they're discreet.
