OK we have some lawyers, here what would would have happened if since this was the only evidence, and neither one had an alibi?
I know (from Law & Order) in NY you can argue the same evedince to convict more than one person of the same crime (even if only one of them could have done it)
Then we have the Missispi? case last year of those kids being convicted for killing their father and an accomplice going free, where the prosocuter took the evidence and told different stories to what happened.

Actually, we had a weird case in Toledo, in which a guy was accused of murdering his ex-wife. However, his twin posed as him and competed in a charity golf tournament to give him an alibi. In that case they were BOTH evil. I believe he was convicted.

In Tennesse, several years ago we had a set of m identical twins that were both in on the murder, too, the Bondurant twins. Each weighed over 400 pounds and they beat a woman to death. They are currently trying to get a new trial or something.

I actually tried the evil twin defence once. I called a guy and then realized I was a complete psycho on the phone. The next day when I ran into him I pretended nothing happened, but I mentioned my identical twin who makes bizarre phone calls pretending to me be. He didn't buy it. That was a long time ago. I'm better now.
