The penthouse apartment is new construction on the roof of the Plaza hotel.
It was originally supposed to be 2 apartments. This buyer bought both before construction began and had it converted to one large apartment. He was required to put down a $10 million deposit before construction began. He's suing to get his deposit back plus money for being defrauded.
He purchased based on original plans and a detailed model. Changes were made without his approval. He was not allowed in to see the apartment until construction was completed.

Tell me more about this walk through he should have done.

The apartment's anonymous buyer, who made the purchase based on a video, is suing the hotel, developers El-Ad Properties and brokers Stribling & Associates for breach of contract, fraud, deceptive trade practices and negligence.

I would never buy property without seeing it for myself. Hell, I wouldn't even spend $1,000 on a vehicle without taking it for a test drive first.

This guy set himself up for trouble.

Well, if he was to put down 10 million dollars, and they didn't let him walk in and inspect the construction process whenever he damn well pleased, he should have known something was up. Seriously. You get more input on a 300k build-to-order cookie-cutter suburban subdivision home. You don't commission an apartment like that and not regularly check up on the process. What, was 53 million worth of property not worth his precious time?

Well, I would think anybody smart enough to earn decent money would look at the place they plan to buy first.

If you spend $53 million for a place, I would think you could make an appointment, and fly a jet out to New York and look at it before plopping down that much dough.

Stupid buyer.

I still think it's a possibility the sellers may be liable for shady practices though. Those kind of things need to be stopped.

A lot of "new building" Apartments in NYC go by these means... you purchase at a reduced rate (sometimes) before it is even built yet. You save money but run the risk of it being a bit "different" than it originally was. In his apparent case according to Psychotropic, he saw a lot of videos and images to show what it will look like. If the final product and the original CGI videos/images are so different in nature and a jury sees and notices it too and thinks this guy got screwed, this guy will get his money back.

Seriously. I never even bothered to look at my Villa in Belize before I bought it. And my ranch in Wyoming- I've never been to yet but, they tell me it's nice.
