Less a Second Amendment Issue than a Fourth, but what a bunch of a-holes they are.

If weapons are recovered, they will be tested and destroyed if they are not found to be linked to any other crimes.

A police spokeswoman said that if evidence of other crimes is found during voluntary searches, amnesty will be granted for that crime as well.

"Chief Lanier has been clear," Traci Hughes said. "Amnesty means amnesty."

Riiiight. So if ballistics proves that a recovered gun has been used in multiple homicides they'll just ignore it. Riiiiiiight.

Police are asking residents to submit to voluntary searches in exchange for amnesty under the District's gun ban.

Amnesty? So they're guilty until proven innocent? Got to admit, that's much more efficient. If only there were a peace of paper with, oh I don't know, a bill of rights maybe, that said something different.

Yeah, sure, whatever. So you say whilst trampling all over the second and fourth amendments.

No guns for you to protect yourselves citizens. Those of us in congress however will have armed security and some of us will have concealed weapons in holsters, purses and briefcases for our protection.

In DC the mere presence of a gun in a home is effectively a crime.

So, right now if you want to kill someone all you have to do is wait for a search team, then allow them to search your home and claim amnesty for the murder they uncovered? This isn't even ment as snark, I really wonder what they would say to that, and how they would try to explain that it doesn't really mean anything.

"May we search your home?"
"Do you have a warrant?"
"No."
"No, you may not."

It's that simple.

That's why you put "voluntary" in quotes. Because it's not necessarily "voluntary" when cops show up at your door and ask to go rummaging thru your stuff.

2008-03-25 7:33:04 PM
Since it's voluntary I assume you could voluntarily tell them to shove it up theur azz, too.

You haven't seen many of the cop threads/stories on fark, have you? Or read anything about the conduct of cops (in general) recently, have you? Cops are law unto themselves.

FTA: Officers will go door to door asking residents for permission to search their homes.

I saw this on COPS the other night, except it was a car they wanted to search: the driver said no, they figured out a way to arrest him, and then searched the car "incident to arrest."

give me doughnuts: "May we search your home?"
"Do you have a warrant?"
"No."
"No, you may not."

...continued, in real life:
"And you are..." (checks clipboard) "John Q. Homeowner?"
"Yes..."
"There is an old warrant for your arrest; failure to appear in traffic court. You're under arrest. We will now search your home, incident to arrest, for officer safety."

Outstanding misdemeanor warrant and you do that? Guess what? I own you, I own your department, I am now a majority stockholder in your state/jurisdiction.

SCOTUS is an improper acronym. It's not the Supreme Court of the United States, it's the United States Supreme Court.

/at least, that's what I was always taught.

You will be rich after they sit your ass in the can for 3 years. Is that a tradeoff a "free" person should be offered?

SCOTUS is a bit easier to pronounce than USSC, and less likely to be confused with the University of South Carolina.

So, it's (1) voluntary search, gun, amnesty or (2) no voluntary search, police assume there's a gun, pretend to hear a noise, exigent circumstances, gun, jail. What a choice!

2008-03-25 10:55:01 PM
This could create an interesting precedent. Are gun bans legal in the 50 states? No. But in DC? Possibly.

Why? Because the copies of the 2nd Amendment as voted on by Congress differ to the copies distributed to the several States back in the late 1700s.

Don't muddy the issue. As long as people are worried about their guns, they won't be asking about pesky things like warrants and probable cause.

Let me make the argument that the area is a district, and not actually part of the United States.
Therefore it doesn't come under any of the local, state, or federal laws regarding hunting or human rights.
All persons in the area will be given 22 minutes to vacate.

game on

The LooseCannon: Why? Because the copies of the 2nd Amendment as voted on by Congress differ to the copies distributed to the several States back in the late 1700s.

I thought it'd be because DC isn't, technically, a state. They didn't have any representation in the US government, nor even a local government, until fairly recently (in terms of US history at least).

I would say its a dead heat between the idiot that thought up this idea and the dumbass in the thread above this that tried carjacking in the jail parking lot.

If a man's 4th amendment rights are trampled in favor of removing his 2nd amendment rights, does the ACLU give a damn?
