Most supermarkets put those big rubber pads down in front of the grapes, cherries, etc to prevent injuries like this happening.

I once worked with a guy who used to say random weird one liners and stuff in a funny Strongbad voice around the lunch room. It was a quirk of his sense of humour.

One he said this:

"I was graped!"
"Huh? You mean raped?"

Meh, was actually quite funny when he first delivered it. Not as good without the silly voice though.

Interesting. I am a personal injury lawyer, I -hate- slip-and-fall cases and typically don't take them. The ones that are really bad though are -trip- and fall cases- where people fell over something that was lying out on the floor in the open. "Why did you not see it?" "I don't know." Oh, great.

Usually you can settle a slip-and-fall case for some amount of money, but it is generally on a comparative-fault basis- i.e. the same injury that would be worth $10,000 if it was a rear-end auto accident, will be settled for (say) between 3 and 7 grand. To fix it where the client gets any decent recovery you have to reduce your own fee, then convince the doctors to reduce their bill so everyone gets paid. Not really worth it.

The Prosecution QC in the trial of my Nephew's killers at the Old Bailey was a circuit judge simultaneously hearing cases at Reading Crown Court, and was chummy with the judge we had at the time to the point of giving him advice in the middle of the trial - including more than once at the request of some of the defendants barristers!

As to the age of the case - proceedings would have started ages ago if this is at a high court now.. If nothing else it takes anything up to a year or more to get some cases listed. A recent personal injury case I brought took a year of discussion (between my solicitor and the insurers for the company whose door took the tip of my finger off) before they'd even admit any liability. Every communication in each direction gets 21 or more days leeway for a reply, and the insurance companies always, always stretch it to the limit.

This could also be a retrial or an abandonment or something, since there's nothing shown in the listings to state that a previous trial has occurred. We had two retrials and a thankfully unsuccessful appeal trial in the murder case before (hopefully) final convictions, and the jury in all of them were not allowed to know there had been any previous hearings, to prevent tainting their judgment.

How the hell do you slip on a single grape? If a kid with a smaller shoe size (thus less space for traction on the ground around the grape) steps on a grape and doesn't slip, how does a fully-grown adult step on a grape, slip, and injure himself?

When I worked in a grocery store we watched a person looking at the floor for a while. Upon spotting a grape (or some fruit) on the floor they proceded to sit down and wiat for an employee to notice them. When someone got close they started complaining about falling. The employee said we saw you sit down. At that point they got up and calmly left the store. Who do you think you are dealing with? No witnesses equals no case.

I hope he wins. Any time the people can hold these fat cat corporations accountable for the damage they do to other people is fine by me.

It was their store and they have a responsibility to ensure a safe environment for everyone who goes in there. It's only a grape to you but it could cost someone their life and these dickhead neocons who run these empires can SUCK MY DICK.

The store has a duty to keep the floor clean. The grape on the floor certainly could cause the guy to slip, and those damages aren't completely crazy. I don't see the problem here.

The store may have an argument that the grape was only on the floor for a few seconds, but that's for the trier of fact to determine whether the store cleans the floor in a reasonable time. But I certainly don't see this case as anything rare or extreme.

Not enough facts to determine what I would do as a juror. Most likely would find for the company considering the small amount of details I know from the article just because shiat falls on the floor and a store can't pick it up immediately. But again, this case isn't off the wall.

I've actually slipped on a grape in a supermarket. Someone had accidently dropped a couple of them on the floor over by the meat department & I stepped on one & landed on my arthritic knee, giving it a hard bang on the linoleum floor. Needless to say I didn't sue, but you never saw the store manager & a few other employees run up to me vert quickly to make certain I was okay.

Grape slips are unbelievably common in Supermarkets. If you've worked in the industry (or personal injury law) you'll know that stores generally keep excellent logs of cleaing/inspections around the grapes, because they get sued over this so often. And they have a responsibility to keep the area clean, but there's limits on what they can do.

It's not the banana peels that get people, it's the grapes.

Fascinating. According to Wiki, England has a 2-year statute of limitations for torts. One day perhaps I'll learn, not from personal experience, how the personal injury system works in Britain.

Sorry about your nephew; I am glad to see they appear to have gotten a conviction that will finally stick.
