Attempted murder is more like it. Shooting someone in the face is attempted murder. Also, lets throw in discharge of a firearm; reckless endangerment, assault W/ a deadly weapon, exc, exc.

Gun crimes should be prosecuted to the fullest extent of the law.

Yes, pretty normal. Back in the day, though, it was more of a friendy ribbing kind of thing. It basically breaks down like this...

Army=too stupid to get into another branch
Navy=gay
Air Force=bunch of wimps afraid to join the actual military
Marines=bat shiat crazy braimwashed mili-zombies

For the record, most are generally true, and the Marines are the most badass.

Sucurity guards are some of the most unhinged people you'd never want to meet. Most are just regualr folks doing their job, but some are people who failed the Police Psych exam and for damn good reasons.
I've worked with some guards that were straight up insane.

I remember a fight in the parking lot of a 7-11 between these two losers who both got kicked out of the Marines. They were yelling at each other, "You ain't a Marine!" Odd, since neither were Marines having been kicked out during boot camp.

Murder needs intent, you can file for the aggravated assault and then build your case and upgrade the charges to attempted murder or murder 2 of the victim dies.

This way you don't run the risk of the judge throwing it out at a preliminary hearing if you don't have your crap together to show intent. If that happens the perp goes free until you refile.

Alot of us guys have trouble turning off the testosterone in a civilian setting [getting better about it]. You get used to being aggressive 24/7 & while I know that's not normal/good, you do what you have to do to get the mission accomplished. Some guys live it long after the deployment is over or after they have seperated from the military. It's hard to untrain the warrior attitude. NOt making excuses for it, it's part of the lifestyle...scarry huh?

its amazing how many times people survive gunshot wounds to the head. i think it might have been best in this case if the bullet had magically killed both of them.

Let me make a slight quibble--most, if not all, reputable shooting trainers teach to shoot for the center-of-mass--which, on a human, is pretty damn close to the chest.

Also, consider 'crimes of passion'--i.e., those committed "in the heat of the moment", where there is no malice aforethought--those generally get downgraded to manslaughter (if the victim dies) or aggravated assault (if the victim lives) because--no matter where the injury was inflicted--the arguement can easily be made that the attacker was simply taking the easiest, fastest opportunity. IANAL, but have been around more than enough of them in my time.

Again, I feel gun crimes should be aggressively procecuted, so that "they" leave those of us who are responsible with guns alone.

I personally think that anyone who promulgates that trite, over-hyped, cliche'd, hackneyed old puke of a phrase "gun crime" should be drawn and quartered, and have their body sent to the four corners of the country as an example.

The same goes for 'computer crime' or 'car crime' or 'knife crime' or any other modifier attached to 'crime'. It's a crime. That's it. If you want to get specific, go by the *legal* categorization--assault, battery, murder, manslaughter.

/It sounds trite, moralizing, and downright stupid, IMHO.

Maybe for the ground-pounder types, but definitely not among any of the vets I know, including myself.

I agree completely but if the guy says I was just showing him the gun we and were arguing about whether DA only is safer or not and it accidently went off. And you don't have an affidavit from a witness that says otherwise he is going home for a couple of days if the judge is an asshole.

Please. Is anyone attacking the Constitution over knives or cars? Is anyone trying to take away your right to have a computer because of porn?

GUN CRIMES are a special category and should be handled as such. It is not trite when a 18 year old wanna be gang member takes out an innocent child in a crossfire. It is not moralizing to acknowlege that GUNS are very dangerous tools that require special rules and laws. If this idiot missed his target, he could have killed a passerby, whereas that wouldn't happen with a knife. There are already specific laws on the books, as there are in COMPUTER CRIMES (What is your problem in calling a spade a spade?) and in GUN CRIMES, like DISCHARGE OF A FIREARM, which are seperate crimes, so your statement is downright IGNORANT.

Your moralizing statement is only valid when looking at so called Hate crimes.

1. a marine (mainly cuz thats all that branch has goin for it)
2. worked behind a desk

Well, it doesn't sound that way in the article. It sounds like he shot the guy in the face during a heated arguement.

The jury can always convict for a lesser crime.

See, I just feel that there are too many GUN CRIMES that get lenient punishments. Some idiot goes ballistic (literally) and gets a slap on the wrist, when a harmless guy with a ounce of weed goes away for years. The idiot with the gun gets out and does the same thing again because he pretty much got away with it the first time. If we locked up the violent, dangerous maggots who use guns in crimes, we as a people would be safer, and I can still have my guns. Instead, we take away our rights to carry, lock up non-violent offenders, and give sweet plea deals to violent maggots.

How does this make sense?

I am not afraid of knives. I am afraid of guns, as they can kill the shiat out of me pretty easly even when weilded by a pathetic, weak maggot.

I don't know. I'd venture to guess that if the best job the guy could find is "hotel rent-a-cop", his military career wasn't too amazing.

I saw somthign on tv last night about the BTK serial killer. Some dude he shot THREE times in the head while he tried to stop him from killing the sister. Dude lived. I'm sure he's all kinds of farked up but thats pretty bad ass.

You should be every bit as afraid of knives as guns, even when wielded by an amateur. A 2-inch-deep puncture wound can cause rapid death on numerous parts of the body.

In most states/counties, attack a cop with a club or your bare hands and he is constrained to subdue you physically or chemically, but not immediately with deadly force--if he just blows you away, he's in trouble.

Attack him with a knife and he is pre-authorized to use deadly force immediately, without even a verbal warning first.
