I never thought I would see the day where I don't disagree with an executive policy of this administration.

That said, I still hate the guy for everything he stands for. (except this little gem)

All I have to do in order to be a hero is to say I'm not going to take your stuff without cause?

davevodolazkiy: That said, I still hate the guy for everything he stands for. (except this little gem)

except this is meaningless anyway. eminent domain is mostly done by state and local governments. The Feds don't use it anyway. So in other words he's said he's not going to do what he doesn't already do.

Hero tag is pointless. And when applied to Bush, desecreted.

Yeah, kinda pointless, since it's only limiting Federal eminent domain seizures, which are rare. And note that it's perfectly fine to grab land for the Admin's Telco buddies.

I was about to say that some really sharp attorney could use this to get a Federal drug raid asset-seizure case thrown out, but of course they were sure to include this bit in section 4:

(b) Nothing in this order shall be construed to impair or otherwise affect:

(i) authority granted by law to a department or agency or the head thereof...

Anyway, just more meaningless pandering. When W signs an Executive Order telling the Federal government to get out of all of our personal stuff -- property, records, information, etc., -- without proper cause and warrants, then maybe I'll give a golf clap.

But I'm not holding my breath.

Everything Bush has ever done in office was done to help the rich while screwing the average citizen. Everything!

This is only for the Federal Government which isn't the state and local governments where we've been seeing the actual problem.

But meh.. progress is progress.

Exactly!

This is just like when the ACLU defends the KKK, or Rush Limbaugh. It's just an example of W throwing a bone every so often.

So the ACLU is just playing politics when they defend the KKK and Oxycotton? Obviously it's a liberal plot to deceive the public to make them seem more objective. They do not understand that everything is determined by the party you picked on a piece of paper and the undying love for your hero.

A pity that the executive order does nothing to actually protect personal property rights from federal intrusion. The order reserves to the federal government the power to take private property to "benefit[] the general public." That's the argument that New London made (and the Court bought) in Kelo.

You've GOT IT!!

Just like this Personal Property SCAM - is a Republican Plot by Bush!

(d) This order is not intended to, and does not, create any right or benefit, substantive or procedural, enforceable at law or in equity against the United States, its departments, agencies, entities, officers, employees, or agents, or any other person.

Translation: This is just Gov't Policy & not law.
If we violate this, you can't sue us.

P.S. Here is Executive Order 12630 -- Governmental Actions and Interference with Constitutionally Protected Property Rights (pops) which the Executive Order references.

Sec. 3. Specific Exclusions. Nothing in this order shall be construed to prohibit a taking of private property by the Federal Government, that otherwise complies with applicable law, for the purpose of:

(a) public ownership or exclusive use of the property by the public, such as for a public medical facility, roadway, park, forest, governmental office building, or military reservation;

(b) projects designated for public, common carrier, public transportation, or public utility use, including those for which a fee is assessed, that serve the general public and are subject to regulation by a governmental entity;

c) conveying the property to a nongovernmental entity, such as a telecommunications or transportation common carrier, that makes the property available for use by the general public as of right;

(d) preventing or mitigating a harmful use of land that constitutes a threat to public health, safety, or the environment;

(e) acquiring abandoned property;

(f) quieting title to real property;

(g) acquiring ownership or use by a public utility;

(h) facilitating the disposal or exchange of Federal property; or

(i) meeting military, law enforcement, public safety, public transportation, or public health emergencies.

Well, that's sure a relief!
