Unanimous.

I don't disagree with the decision at all on the merits, but I am really farking tired of this "we're going to take a shiatload of your money and if you want it back, you sure as hell better do what we tell you to, no matter how counterintuitive or imprudent it might be" federal government that we've had for the better part of a century.

good. makes sense
and i second the objection to federal legislating-by-extortion

I like the cut of your gib. It's good to remember that it is our money to begin with. I forget that every once and a while.

makes sense to me

I agree with kronicfield though too

Yep. I would say it further erodes states rights but there haven't been any in a long time to erode.

I think there shouldn't be a prohibition against gays in the military, and I understand that it goes against the nondiscrimination policies of some colleges. But the simple fact is the federal government is giving them money. I'm sure they'd turn down money from the KKK if they were paying to recruit on campus. If they don't want to have military recruiters on campus because it goes against their philosophy, fine. Then turn down the money and there's no problem.

There's nothing saying that a certain percentage of students are mandated to join the military. The students themselves could organize a boycott if they wanted to.

I just think the anagram "SCOTUS" sounds dirty.

"Honey, don't put those sheets on the guest bed, they've got SCOTUS on them."

I'm glad our military is wasting my tax dollars offering college students the opportunity to give up on a high-paying job for the chance to drive a Humvee in Iran and get his legs blown off by an IED.

Right on.

2006-03-06 10:42:33 AM
The military also needs lawyers. The case was (mostly?) brought by law schools.

2006-03-06 10:47:53 AM
Since most of the jobs available for kids these days are fry cooks and other service industry jobs, I guess it is good that the military can be there to offer alternatives.

2006-03-06 10:48:39 AM
Personally, I say "Fukk the colleges". If the colleges' management had any real principles, they'd tell the government to keep the funds and then kick the military off campus. Instead, they want to be pussies, "Yes, give us subsidies financed by robbing the citizens, but don't you dare send military recruiters to our campus". Bunch of whiny, mealy-mouthed, hypocritical maggots...

That is so 1986.

2006-03-06 10:53:03 AM
Good.

I guess we'll now get to see how principled these "private" institutions are when they're faced with the reality of functioning wholly on private funds instead of some quasi socialist kickback system.

Your right we have outsourced our fry cook jobs now.

Here is then the next question:

Since the schools can't keep the recruiters out even though they violate the school's policy of non-discrimination, does that leave the door open for other discriminatory groups to use university facilities and resources?

2006-03-06 11:09:30 AM

Only if that group has a standing military that can wipe your school off the map.

Not unless the Aryan Nation is federally funded. As I understand it, the fact that the military discriminates against GLBT individuals is irrelevant to the decision. According to SCOTUS, the price of receiving federal funding is having to open the door to military recruiters.

2006-03-06 11:21:49 AM
Teekno

But if the KKK tells you they will stop offering your university endowments unless you cancel Afro-American History 101, it's within their rights.

Programmer Cat: According to SCOTUS, the price of receiving federal funding is having to open the door to military recruiters.

Actually, the price of accepting the funds is accepting any the strings that the Congress may choose to attach to those funds.

Another easy example is federal highway money being contingent on states having a minimum drinking age of 21 years or the 55MPH speed limit before that.

It's crappy but it is legal.

It would be interesting if all those schools did stand on principle and stop taking the money. It will never happen but it be cool to see.

Okay there, Joaquin Phoenix.

2006-03-06 11:52:26 AM
For certain departments in certain colleges, it may be possible to let go of this funding (research drives funding in these departments). But, that would screw over everyone else at the school... I'm sure many professors would like that, so they wouldn't have to "waste their time" teaching.

2006-03-06 11:54:57 AM
LyleDAL: It would be interesting if all those schools did stand on principle and stop taking the money. It will never happen but it be cool to see.

1. The weight of principle at a modern university is inversely proportional to the amount of money at stake. (Believe me, I work at one. So I am really getting a kick out of these replies... ;) )

2. If you use taxpayer money, you have to use it under the conditions the Congress puts on it. This is called the "Power of the Purse." That's the way it's worked for the last 230 years. (Yes, I know that there is a thing called the "unconstitutional conditions" doctrine. But it looks like SCOTUS shot that one down while they were at it too.)

3. Hey Ivory Tower: you're part of this country, too. The military defends your ass whether you want it to or not. You want to get the rules about gays in the military changed, you go complain to Congress, not try to weasel your way into federal money without accountability through the courts.

This is bullshiat. If the military wants to recruit students on campus then they need to abandon the stupid "don't ask don't tell" policy. Haven't we matured at all in the past decade?
