Pet peeve here: "Old MacDonald had a farm" is 7 syllables.  "A house goes up on McDonald Creek" is 9.  If you try and sing the latter to the tune of the former, it just doesn't work.  Ditto with trying to fit "Conservation district says it's got to go" (11 syllables) into "And on that farm he had a ___" (8 syllables).

I wouldn't think a local architect would be foolish enough to site a house so close to the river, and then foolish enough to not apply for the land use permit. Montana has some reasonable stream and river setbacks due to a few egregious houses built in the 80's.

I am thinking a cheesy purchased plan from one of the online catalogs, an unlicensed G.C., and a trash landowner.

I'd go with yes. There was something similar near Red Lodge. A house south of town (right) along Rock Creek was listed for $2.1m, and then after the flooding in June the listing came down. Hm. Wonder why.

To be fair, that was some major flooding last year, and even with a 200' setback would have still been catastrophic.

Is the railcar cafe place still there? I may need a pork chop sandwich this summer.

To be fair, that was some major flooding last year, and even with a 200' setback would have still been catastrophic.

They were right in the flooded area but I didn't go up this year so I don't know. Ricardo and fam moved La Palmitas into the old Mas Taco location and helped feed the relief workers and sandbaggers. Best carnitas I've ever had. Cattail bakery and Babcock and Miles dodged the worst of it too.

I love the process. You need a 310 permit for construction. Since they didn't get a 310 permit, the government is going to force them to deconstruct the house. The irony is that a 310 permit is required for deconstruction.

The people, and government, of MT don't take kindly to outsiders. As a non-resident, I have had to deal with them, and they make paperwork a real PITA. Filing a state tax return has some unique rules for non-residents that other states do not.

Complaints were coming in from the moment the illegal construction began.
Not sure why you think the lawbreakers are being made to suffer for having to remove their illegal construction but the asshats deserve to suffer.  The damage they caused won't be easily repaired.

Unfortunately, it seems as though most of the Californians moving here just want to recreate what they've left: every Californian that has moved to my road, a non-maintained dirt road, immediately starts campaigning for the road to be paved 🤦  I tell them if they want a paved road, move to one.  They also let their dogs run loose, despite that it's against the law, and whine when the dog is shot for harassing livestock or wildlife.  And when you try to tell them anything their response is "well, that's how we do it in California".

I wonder if there's a way they could have avoided anyone being able to stop them on a whim for not having a permit when they were almost done building.
