When will these idiots learn?

Punching someone in Florida will get you prison for years.

Shooting warning shots in Florida will get you 20 years MINIMUM.

If you're going to attack someone in Florida, you need to shoot to kill in order to be able to legally defend yourself.

Fatally punching a man sounds like you punch them and they die from the punch. He died from hitting his head on the pavent after being punched.  The punch caused his death, but the punch itself was not fatal.

"He was such a joyful person, very caring to everyone," the victim's son Juan Ricardo Hernandez Jr. said, translated from Spanish, according to NBC Miami. "A beautiful person, there are no words to describe who my father was."

OK so not joyful or caring or beautiful.

That is kinda what it sounds like, but not. When one performs an action? You're also responsible for the reaction(or post-action).
The punch was not supposed to be fatal, but it directly caused the fall and death. Hence the "Involuntary Manslaughter". That what it was. So the punch..."technically", did kill him. Obviously not on purpose, but, he kill him.
Be curious to know more about the precursor though. (No not really. Don't care that much).

Nothing good ever comes out of road rage.  The best case scenario is you get yourself all worked up and nothing happens.  Much more common scenarios are you crash your car, get beat up, get shot, or get arrested.

1. Love me a good soap, so headline so good.
2. I have a 6'4'' friend who got stopped by a road rager. He unfolded himself from the smallish car he was driving when confronted, and the rager calmed down quickly.
3. He keeps telling me I have SMS (Small Man Syndrome). I'm nearly over it :) 5'7''

Surprising that this guy went to jail for this in Florida. Some asshole road rages at him, he defends himself, he ends up in prison for five years. Isn't this what "Stand your Ground" laws were supposed to prevent? Note that the "victim" had been in a physical fight just two hours before he started the one which got him killed, a fact which was prevented from being presented at trial.

Oh, I never said he wasn't responsible. Just that to me "fatal punch" suggests that the punch, directly, caused death.

If you said someone was fatally shot, but what happened is that they were shot in the shoulder and then fell off a building and plummeted to their death, it seems like a weird way of phrasing it, even if the shooter is still culpable for their death (and they are).

Appears the key fact is that he punched the guy when he was walking away.

Wasn't the original ground-stander also?

And if he punched the guy while walking away, sure it's preferable to not do that. But I'm also not outraged about him only serving five years about it either. The other guy could have gotten back in his car. He could have refrained from getting out of his car and hitting the other guy's car and threatening his family. It sounds like Mr. Lyle is remorseful about the death. It doesn't sound like the family of Mr. Hernandez has acknowledged that the main reason that Mr. Hernandez was killed is because he was a violent person who went around threatening the public until someone finally put him in his place.

5 years for killing a guy cause you were mad about their driving.   He's not even white, but I guess exceptions are made for rich minorities.

It's a valid legal argument. And also a valid bar question. At issue is the puncher's state of mind when he threw the punch. If you want to get really pedantic, but also really understand the issue, was the guy intending to "kill" the person, did he not care if the person died or not, was he defending himself in a flurry of punches, or was it just a friendly/hostile mutual combat situation like in any bar fight anywhere?

Now in this case, chasing down an old man and sucker-punching him kind of destroys any argument that this was a "self-defense" or "mutual combat" situation, but there's room there for a good defense attorney to argue lack of intent to kill or harm (as clearly happened).
