They can't have been serious threats.

Usually you put threateners in jail. So they can't, you know, carry out their threats.

That's how they caught him.

Oh wow, I used to go there lo these many years ago. It was a weird place--it was divided between the Hartt School (music/dance) and the Hartford Art School ("Hartt School-Art School") and the rest of campus. The two arts schools had students who had earned their way in, and most of us were from economically modest backgrounds; the rest of the university was rich kids and legacy admissions. Which made for a pretty palpable divide.

It was my first experience with actual wealthy people. Like trust fund babies and stuff. It was, and still is, baffling. The weirdest thing for me was that so many rich people are just so boring. I can't imagine having that much money and not always looking amazing and having a really interesting house and supporting all kinds of arts organizations and whatnot. They were just uninteresting and dressed blandly and they all had expensive but un-flashy cars. They all worked in insurance because of course they did. I suppose old-money-style wealthy people don't stay that way by actually spending their money.

The Supreme Court ruled about threats long ago.  If I remember correctly, the threat must be plausible and imminent to lose 1st Amendment protection.  It's unlikely this online threat meets that threshold.

Yik yak is open about the fact that while your posts are anonymous to other users they will rat you out of law enforcement comes around asking questions.

A few years ago when Yik yak stared I was I law school and my buddy said ale run for about it like "who looked at Twitter and said what would make this better is if it was anonymous?" It had a certain me s room wall aesthetic of bomb threats and racism. Needless to say it folded in a year or so. The current Yik yak is a reboot.

Tom Marvolo Bombadil: Ah, Yik Yak, the 4chan of Nextdoors.

The best part about the original Yik yak was that it was GPS-driven and showed you postings within so many miles of your location. I'm close enough to San Diego airport that I got a lot of "looking for great head in terminal 2," and, "layover at the Holiday Inn Bayfront, who wants to smash?"

Except in this case we have a cop flat out saying the kid was clearly joking in at least some of the chat, so can be assumed it was never a threat. So not even attempted, or desired. Just the mere thought about and utterance of, even in jest are now treated the same as a clear and deliberate threat

"The threat, according to Hartford police, mentioned shooting a dorm and made other firearm references."

You can't yell "FIRE!" in a crowded theatre, or talk about having a bomb in your bag at the airport and then avoid consequences by claiming it was a joke.

This guy clearly said enough for it to reasonably be interpreted as a threat. If they then subsequently establish iat was a joke, then his punishment will he reduced accordingly.

If I yelled at a stranger that I was going to break their nose it's still assault (if I put them in genuine fear) even if I don't mean it. (UK law, offer not available in other jurisdictions).

No. You can think what you like.

If you post it online then you take the consequences.

Consequences will be different if you can show you were joking.

I know, right? My uncle was carrying his life savings in bonds in his carry-on and when TSA asked why he was carrying it so protectedly he joked it was a bomb... They apparently couldn't take a joke because the bomb squad blew his bag up, he spent 6 months in probation, and is still on the no fly list

"The student was identified as Tenuun Enkhbat, 18, of Virginia."
"Parents said they did not received any communication from the school about the investigation."

Dear parents,
You failed.  You had a job to do: raise a functioning adult.  Once that child turns 18 you no longer get to poke your nose in without permission and no one is required to tell you anything.  In fact on many cases it is against the law to tell you things related to your offspring or the actions of your offspring.
If you still have children <18 years of age, get to work fixing them.  If you don't, please do the world a favor and don't have any more.

I lived across the street from a combined elementary school/junior high, so my apartment was blocked from the app.

I'm not sure how Yik Yak works, but it sounds like it was a chat between people that knew each other

And of course you are completely overlooking the profundity of the Cop's statement
The Cop outright says it was said jokingly, then covers for the arrest by claiming some BS about "zero tolerance" and throwing critical thought out the farking window by treating comments made in clear jest as terroristic threats to be prosecuted just the same as if made by an actual would-be school shooter with intent

But hey, keep on doing your dance around the facts and keep on licking those jackboots while we all slide our way into a totalitarian police state where thinking the wrong things or saying the wrong things will get you locked up, or even executed

Screw you. I'm no US police apologist.

It's not my problem if you can't handle more than one possible interpretation or that maybe, just maybe, there should be some reasonable level of investigation before writing off specific violent threats against a college as "a joke".
