so a photographer took her picture in a public setting.. and now she wants to claim its been stolen? do i have that right? cause it seems like she just doesnt like the person who used it. the artist who took the photograph authorized its use.

The picture was taken at UCLA and California has very aggressive right of publicity laws. Beyond that, IANAL and I've never actually read the text of those specific laws. There's also a big difference between being in the background of a photograph and it being a closeup of your face. Given that this was an album cover made 17 years ago, there could be statute of limitations issues as well. And generally, I'm in favor of any resolution that doesn't involve giving money to lawyers.

Thanks to Disney, it's 95 years from publication for works for hire or 70 years after the death of the artist.

A shoot for an album cover is work for hire, unless otherwise agreed, and the rights go to whoever paid the photog
