Suppose you tell us what exactly is involved in filing a public protection waiver to begin an investigation of this type, and what needs to be presented to the Chief Trial Counsel to demonstrate a violation of the codes as charged; and why in your estimation that could have been done any sooner than now.

The code sections are Business and Professions Code section 6086.1(b)(2) and State Bar Rule of Procedure 2302(d)(1), just to get you started.

He wasn't caught red handed stealing money from his client, so the fact that disbarment is on the table at all is remarkable.

That said, yeah disbarment ought to be the least of the traitors' worries.

Whoops.  Swidler case has different facts --- it was death of client, not lawyer.
Regardless, the privilege will still normally apply.

The privilege was probably gone at yhe point Judge Carter ruled that it was more likely than not that the communication was in furtherence of criminal acts.

Watch Law and Order. It always seems like the crime to the investigation and then to the trial flow quickly.

But they always add dates to the splash screens. The quick, open and shut cases take months. The ones based on true events take years.

I feel like many people are completely unaware of how slow the legal process is, and why it needs to be that slow sometimes.

Attorney client privilege belongs to the client, not the attorney, so it's not his decision to make in the first place.

Shouldn't be eligible any longer.

I knew a priest who was defrocked and laicized (not only kicked out of the priesthood, but the freaking Vatican took steps so he's now not even allowed to refer to himself as a former priest- it's like he never was) and if someone tried to confess to him he had to make clear he no longer had the seal of the confessional.
