The theocratic tribunal the tries to call itself a Court should be ignored at this point for having a lack of ethics and a couple of republican criminals  acting in personal interest.

A body that can unilaterally impose unpopular laws and strike down basic rights (that are either enforced or ignored depending on your neck of the woods), is wholly unnecessary and by definition anti-democratic.

It's smart for the Biden administration to tout how many people will benefit from this but for the Court. It's an immensely popular program with the only opposition coming from hard bitten reactionaries who are going to oppose anything from the Biden administration.

The Supreme Court claims to be immune to political pressure. Test that resolve with extreme pressure.

Nobody is going to be storming the barricades over this, even though they should.  Government needs to be terrified of its people.

At most, it will erode the legitimacy of the Court. It's a real stretch of the concept of standing. Unfortunately, people don't get riled into a bloodthirsty rage over arcane questions of civil procedure.

The justices will consider the lawsuits brought by six GOP-led states, which argue that forgiveness will disrupt state entities that profit from federal student loans, as well as a lawsuit backed by the Job Creators Network Foundation, a conservative advocacy organization, featuring two borrowers in Texas who are partially or fully left out of the president's relief.

The fact that the justices have agreed so quickly to take both cases suggests that they're eager to deliver a decisive ruling on the policy involving more than 30 million Americans, said Laurence Tribe, a Harvard law professor.

Like other legal experts, Tribe doesn't have much hope that the plan will survive the Supreme Court.
"It's basically put the program in deep freeze until it proceeds to most likely dismantle it," Tribe said.

Higher education expert Mark Kantrowitz agreed that an eagerness to make a ruling doesn't bode well for proponents of the president's plan, "because ruling against forgiveness is less complicated."

Dan Urman, a law professor at Northeastern University, also predicted the Supreme Court will rule against Biden. He said the conservative justices believe government agencies exert too much authority and "violate the separation of powers."

"These borrowers could be benefitting from the Administration's program right now were it not for lawsuits brought by elected officials and special interests," a White House fact sheet said.

Forgive the debt anyway and force the SCOTUS to make a ruling on a moot issue to show just how broken and illegitimate they really are.  Force their hand for a change.

Its true that the Supreme Court doesn't have an Army, but neither does the President.  He is the Commander in Chief, but the troops swear loyalty to the Constitution, not him.  And if the courts decide the President is acting unconstitutionally, then soldiers have to determine whos argument they find more convincing.  And if we are at the point where individual soldiers are making constitutional determinations on which branch of government's orders to follow, things start to get really dicey.

If you recall, this was a pretty major sticking point during the last administration, when the military repeatedly pushed back when the President tried to order them to do things they knew they were not allowed to do.

I never once asked for a taxpayer dime to pay for my schooling. I went to all public schools. Hell, even in college, I used the G.I. Bill.

Is this TOTAL loan forgiveness or the $10-$20k forgiveness?  Article wasn't clear.

Either way, fingers crossed it goes through but jeez, if SCOTUS is on it I'm not putting money on it.

I paid off all my student loans with the sweat of my brow and I paid off every dime. Not a boomer but only one year off. The kicker - I graduated in the late 80's and my student loans were about 12k. I also got a couple of small pell grants without which I likely never would have went to college. What did uncle sam get for his investment in me? A dude who has worked full time and paid all his taxes annually since the year I graduated 34 years ago. Never used any public assistance since the pell grants which were probably less than 5k total. Never had any unemployment.

Am I angry some folks are now getting their loans forgiven? Hell no! I think it's wonderful. They system became fare more unsustainable and predatory than it was when I was going through it. I think I was making $12-15 an hour when my loans were paid off. Nice job Biden. Old people should stop whining. If you want the young people to take care of you you gotta take care of the young people so they have a fighting chance of being in a position to do so.

So SCOTUS will essentially have to invalidate the HEROS Act or rule that the pandemic didn't constitute a qualified national emergency even though it was a declared national emergency. Awkward.

I rather expect they'll try to duck and decide the plaintiffs lacked standing.

The HEROS Act gave the Administration authority to forgive student loans. What authority can you cite to forgive mortgages? What's that you say? None. You don't know any of that stuff and are just trying to be clever? Try harder.

The case that allowed the freeze was some bullshiat if I read it correctly.

Wasn't it that MOHELA would make less money and that would affect their ability to pay the bribe money they promised the state for whatever farking reason they're throwing money at that state?

How in the fark does SCOTUS justify that? We don't bail out businesses when they make less money on an investment than they thought they would. Isn't that what's happening here? MOHELA thought they would make $X on Student Loan Debt collection so they promised to give the state some money, and now they might not be able to because they could bring in less money?

What a crock of shiat. And why do I give a fark what MOHELA promised a state that I don't live in?

A better idea might be to stop creating these 'Gold Rush Town' universities with federal subsidies.  Outside of community colleges, tuition is ridiculously expensive in most universities - where you'll go (LOL) to learn about the evils of capitalism.


The Supreme Court should rule the right way.

Congrats!  My lender hasn't said anything about it to me yet. But I was a Pell recipient so knocking $20K off go a long way towards bringing retirement closer.

Honestly, forgiving it makes strategic sense. I wouldn't put it past them to try, but it looks way uglier for the Supreme Court to demand millions in forgiveness be clawed back from people than it is to have them try to block it from happening.

And yes, I'd love to know how they'd plan to force the government to take that money back.
