Lots of people have a grudge against MS so they get singled out for enforcement.

There's should really be a lot more enforcement against merging across the board, but there's not, so singling out MS is unfair.

Sony's exclusives aren't the equivalent of Microsoft's massive size and market power. Sony couldn't afford Activation if they wanted to and if MS was as small as they claim, they wouldn't have been able to afford it either. MS clearly used resources and weight from the entire company, not just the games division, to buy Activision. So their claim that Sony is actually bigger and more powerful doesn't hold up. It's like if some trillionaire uses the fact that you live on a beach as a sign that youre actually wealthier than them because none of their 10 houses are on a beach. Its silly. Context matters.

Microsoft already has a shiatton of game studios under its belt.

I'm glad they started blocking these buyouts, and you have to start somewhere. This shouldn't be the only buyout they block.

Just a Note they do not mention Nintendo which is not quite fair as they do control a slice of the Console market but it is also understandable as Nintendo's main operations are all in Japan as are it's Corporate offices.

Yes they have a US division and division for other regions but they  would have no say so if Nintendo was to attempt a merger on this scale, say buying Capcom as some rumors used to suggest they might do and US regulators would have no veto on it as it would involve two Japanese companies.

Hence the past tense. When I was in the market for a new console you couldn't find one for less than a $400 markup, so I got the Xbox X One X Series X: Part X: This Time, It's X, instead.

I thought that was what the FTC is arguing, not Sony though. Not to mention, MS seems to be arguing that "Sony has exclusives too!" But MS isn't arguing that this Sony has a monopoly or too much control over the market. Greater market control and influence from Sony's end has to exist outside of exclusives for this argument to have sway I would think. MS might be able to argue that Sony's push for $70 games is a sign of market dominance. Maybe.

Sony's is $100B.

So Microsoft is worth 19x what Sony is worth.

Vertical integration, title exclusivity, and numerous other aspect of this are pretty complicated, and MS is going to focus its arguments on aspects that make the acquisition not appear anti-competitive. That said

Smith added that PlayStation has 286 exclusive games while Xbox only has 59. "So the administrative law judge is going to have to decide whether going from 59 to 60 is such a danger to competition that he should stop this from moving forward."

I don't understand what he means by this. Acquisition of AB will increase the number of exclusive titles on XBox by exactly one? Which title?

If you want to argue MS is leveraging other divisions' assets to help its game division, Sony does the same, including owning one of the Big Five movie studios.


That's a fair argument (depending on how successful Sony pictures is. I thought it was failing a few years ago, but could be incorrect). Also, Sony is not as big as MS at least in market cap. Sony has a market cap of 100b or so and MS market cap is nearly 2 trillion. Sony cannot compete with the sheer market dominance of MS as a corporation.

I thought that was what the FTC is arguing, not Sony though. Not to mention, MS seems to be arguing that "Sony has exclusives too!" MS arguing that Sony has exclusives to is a good point by them because that's the main argument Sony is making, that it would be detrimental to the market for Microsoft to potentially make the highest selling game exclusive. Of course Sony does this often with third party studios as well, making arrangements for timed or completely console exclusive titles and currently still do, like with FFXVI. So it makes Sony's complaint ring hollow because they'd make the same move if they could afford to.

MS has been and is making the claim that Sony has too much control over the market, they've pointed out how Sony has sold several times more consoles than Microsoft has, how much influence over the market they currently control and how Sony is mostly doing what it's doing to prevent MS being an equal competitor.

But the FTC isn't wrong to make the attempt to due all the diligence for such a large merger. That's working as intended. Though I'm not sure how anyone can argue that Microsoft as owner will be worse for either consumers or workers than Bobby Kotick run Activision.

Call of Duty is the title Sony has been complaining about.

It's actually kind of amazing. I worked for Activision doing email tech support when I was in graduate school for extra money. Back then, they published dozens of games a year. In 2001, Activision published 41 games. In 2022, they've published *one* - just Call of Duty (Blizzard not included in these numbers).

The sort of amusing thing is that for the last few years, Sony has been paying Activision incredible amounts of money for some exclusive Call of Duty access - it sometimes releases earlier on Sony consoles, the PS version has extra features, more game modes, etc. Xbox players have complained about this for years. Now Microsoft wants to buy Activision and is even willing to guarantee Call of Duty on PS platforms for a minimum of 10 years (but perhaps with Xbox extra features) and Sony is crying foul.

Sony's exclusives aren't the equivalent of Microsoft's massive size and market power. Sony couldn't afford Activation if they wanted to and if MS was as small as they claim, they wouldn't have been able to afford it either. MS clearly used resources and weight from the entire company, not just the games division, to buy Activision. So their claim that Sony is actually bigger and more powerful doesn't hold up. It's like if some trillionaire uses the fact that you live on a beach as a sign that youre actually wealthier than them because none of their 10 houses are on a beach. Its silly. Context matters.

Then they should have said something that, and not "They're going to use their market share to do what we've been doing, only more!"

I thought that was what the FTC is arguing, not Sony though. Not to mention, MS seems to be arguing that "Sony has exclusives too!" But MS isn't arguing that this Sony has a monopoly or too much control over the market. Greater market control and influence from Sony's end has to exist outside of exclusives for this argument to have sway I would think. MS might be able to argue that Sony's push for $70 games is a sign of market dominance. Maybe.

MS arguing that Sony has exclusives to is a good point by them because that's the main argument Sony is making, that it would be detrimental to the market for Microsoft to potentially make the highest selling game exclusive. Of course Sony does this often with third party studios as well, making arrangements for timed or completely console exclusive titles and currently still do, like with FFXVI. So it makes Sony's complaint ring hollow because they'd make the same move if they could afford to.


This is the crux of it. Sony thinks it's unfair, not because MS is doing an anticompetition, which it is, but because they can't afford to do something similar with their current resources and darn it, it's just not FAIR!

And for all the folks tossing billions around talking about market cap, make sure you're comparing the game portions of the studios. I seriously doubt the XBox division has almost 2 trillion to throw around. Most of that is O365 and Azure.

Call of Duty is the title Sony has been complaining about.

It's actually kind of amazing. I worked for Activision doing email tech support when I was in graduate school for extra money. Back then, they published dozens of games a year. In 2001, Activision published 41 games. In 2022, they've published *one* - just Call of Duty (Blizzard not included in these numbers).

The sort of amusing thing is that for the last few years, Sony has been paying Activision incredible amounts of money for some exclusive Call of Duty access - it sometimes releases earlier on Sony consoles, the PS version has extra features, more game modes, etc. Xbox players have complained about this for years. Now Microsoft wants to buy Activision and is even willing to guarantee Call of Duty on PS platforms for a minimum of 10 years (but perhaps with Xbox extra features) and Sony is crying foul.


Can Xbox and PC players use Spiderman in the Avengers game yet?

Not cancelled, but a lot of the Toys For Bob team were reassigned for Call of Duty: Warzone support.
