Professional illustrator here, no, it's not "traced" it's not even likely a paint-over, there are quite a few flaws in the general structure. The person is obviously very skilled, the paint mixing and rendering is pretty impressive. You can copyright a photo in a way that the photo itself cannot be used without payment - but you cannot keep someone from painting your photo - even if it is verbatim; it isn't tantamount to plagiarism because the medium of communication is different.

So, following up on this, lets ignore the basic idea that painting itself is transformative in its very nature, let's examine the elements of the photo that could be copyrighted.

The composition? No, you can't copyright a composition, framing is a basic element of art.

The likeness? No, you cannot copyright a likeness.

Clothing? No, there probably already exists a copyright for that(oh, did they pay a liscencing fee for the right to depict the dress in the photo?!)

Flowers(did they pay for a liscence for the artist that created the bouquet? Or the person that grew the flowers? Or of they're fake created the flowers?) No.

Makeup? Did they do their own makeup, or was there an artist involved there too? Nope, can't copyright a "look".

There are exactly zero single elements that can be copyrighted in the photo, so only the photo itself is an enforceable copyright. That is why they lost the lawsuit.

yeah that sounds about as freaking generic as i can imagine, how do you singularly copy write that amount of genericness?


yeah they do look a lot a lot alike, and yet at the same time they display very differently, what appear to be the same basic imagery. similar yes , and yet distinctly different too.
