I think it's worse than that The SCOTUS may rule that freedom of religion means Christianity only.

Once they get that, they can start the infighting over which flavor.

This Calvinball method of running SCOTUS is going to provoke some extreme responses by the people being deprived of their rights.

If only there were a system of checks and balances in our government that could have been used to protect us from SCOTUS in the last 2 years.

[W]hat if a business owner were to say that he doesn't want to serve interracial couples because he views them as acting against God's law that marriage should be between people of the same race? Waggoner dismisses that argument, noting that when the Supreme Court declared marriage a right for same-sex couples in 2015, the court, as she put it, "explained very clearly" that many "decent and honorable" people hold beliefs opposed to same-sex marriage. In contrast, she says, "interracial marriage laws are grounded in white supremacy and they're designed to subjugate an entire class of people."

No matter how close they get, the bigots will never make the connection. Because they don't want to.

/ if only Brown vs Board of Education had use the phrase "decent and honorable"

Cherry picking the Bible makes it easier to justify crushing the people you hate and be backed up by sky wizard in the process.

I imagine she is violating several religions tenets she is just choosing to ignore.

Why do they bother calling it an "argument" when the vote is already a known quantity.

2022-12-05 9:56:12 AM
"Does my closely held religious belief allow me to discriminate against someone on the basis of sex?"

If the answer is yes, then the list of protected classes is utterly meaningless.

All of this could be solved if we just gave them their own shiatty country to be bigoted assholes to each other in.

I don't understand why we (on the left) are trying so hard to compromise and coexist with people who openly, proudly, and vehemently hate us.

Let them have 25 states. We all know which ones we could part with. Let them have the states, let them build a wall, let them start an exodus to those states, and let them self govern and get their stinking ideology, hateful creed, and backwards politics out of the United States.

Conservexit, folks. It's the only way.

if one can descriminate on religious grounds, then we allow for the whole exclusion and persecution of any minority.  if religiosity can over ride all other rights, then all other rights are then forfeit.

We are already seeing rights to deny specific services, but what happens when religious rights allow for denial of housing, or other essential services.

Medical care is already being denied to some. as is child care.

when one right is allowed to supersede all other rights then there are no rights.

No, they already have their own country.  we live in it and they are looking to suppress the rest of us.  its not enough for them to practice thier faith amongst themselves they must oppress others in the name of thier faith.

Let her do her bigoted bullshiat. Only thing is, no tax breaks for her business. No taxpayer subsidized deductions for her to keep spreading her hate. Pay full tax on every dollar she takes in. Give to Caesar and all. I believe that is actually in her book of pagan fairy tales, so she should be OK with it.

I've read the Bible, in its original language, many, many times; and I have yet to see a verse that says "thou shalt not design a wedding cake for two people whose gender expressions match."

// I guess it's one of those creative liberties taken by King James' translators in the farking 17th century
// If she wants to stand on a Bible verse, she'd be calling for the death penalty for those guys - and somehow, I don't think that made it into the briefs

I can't possibly predict how this will go on a court dominated by gross catholic weirdos that were placed in to their jobs by the same backers.

2022-12-05 10:02:16 AM
"I want to create and design for weddings that are consistent with my faith," she says, adding that she "can't do that that because" Colorado is "censoring and compelling" her speech by "forcing" her to create custom websites "that would contradict" her view of marriage. So, even though she hasn't actually launched a wedding website business yet, she is pre-emptively challenging the Colorado's public accommodations law as a violation of her First Amendment right to free speech and expression.

Ignoring the broader argument here, it seems pretty silly that a court even found this case had standing to begin with.  As near as I can tell the plaintiff has suffered no meaningful harm from any government policy beyond that which exists in her own head.

I asked my Libby Lib lawyer friend about this and it kind of stumped her.

Firstly, F these bigots.

Secondly, what if a customer comes in and asks for a cake with a picture of Hitler being felated by Biden or Trump.  Assuming SCOTUS finds in favor of the gay couple, would the cakemaker retain the ability to say, "no, I don't do cakes like that?"

While "Hitler sodomy" is a very outrageous example, the real question is do businesses retain any ability to refuse service if they believe the content requested is not on brand for them or offends them?  I think these bigots are A-holes but I am not sure how you thread the needle between religious bigotry and reasonable limits on the type of work one does.

The plaintiff in the case, instead, is business owner Lorie Smith, a Colorado web designer who for the past decade has created all kinds of custom websites for clients.

"The pieces I create are art. They're one of a kind. They're unique," she said in an interview with NPR. "I cannot create something that violates the core of what I believe."

biatch, you make websites.

[theyre-the-same-picture.jpg]

There is no such thing as freedom of religion without freedom from it - take it from an agnostic Jew steeped in Talmud-style Aristotelian argumentation.

If I am free to believe and practice as I choose, then it's no farking business of anyone's - least of all the government's - whether I do or not, or how closely I hew to the dictates of a religious tradition.

Do you have a corporation? An Inc, LLC etc? Are you required to register with the state and have a state issued business license?

No one is asking you to gay marry people, no one is forcing you to have same sex with someone else. You want to serve the public a service or product? You have to server the entire public without bias or discrimination.

Christians, always using the bible as cover to be bigoted scumbags.

This article is a perfect example of the difference between art and graphic design. Websites are clearly not art, they are graphic design that can host art. This is such a perfect time to see the social harm done by conflating graphic design and art is real. I hate this is ahppening but love the demonstration.

Yeah, it won't work like that.

Christians want 'Jim Crow' laws for LGBTQ people so they can legally treat them as second class citizens. It is as if the only way to be a happy Christian is to have an entire group of people to shiat on to make themselves feel superior.

It sounds like she does have a functional website creation business, but she hasn't made this specific type of site yet.

I'm perfectly happy to say she doesn't have standing, but I'm not sure she has to wait until she's been asked to make an LGBT wedding site before she can challenge the law.

Then again, dismissing everything on standing is the conservative approach, so...
