These kinds of laws are a fairly recent development (at least in Georgia). The law allows the Governor to suspend another elected official for certain things, usually criminal indictment. They amended Georgia's law last year to say the suspended official wouldn't get paid while they were suspended.

This change came about after our state Insurance Commissioner (Jim Beck) was indicted for fraud and money laundering. He was later convicted. He was suspended after the indictment, but was still getting his Insurance Commissioner salary, until he was convicted.

Governor Kemp has done the same thing with a Sheriff who is under Federal indictment. I'm far from a fan of Kemp, but he's used this authority correctly as far as I can tell. 

It's not a per se a bad thing, but in DeSantis' case, he's abusing the power because the prosecutor publicly disagreed with the policies.

Not really true, the law gives him the power to do this and honestly based on the article it sounds like it may stand.  He's likely got solid footing to say "X isn't doing his duty be refusing to enforce my stupid law"

Now prosecutors use prosecutorial discretion all the time and just ignore violations of the law that they don't... care about, so maybe it'll be overturned (that would make sense to me) but you know... he's not doing something totally insane here he's just doing it for a bad reason because he's a bad person.

I haven't been following this case too closely. I suspect it would hinge on whether there is a documented pattern of behavior and action by Warren to consistently refuse to prosecute the law based on political leanings instead of the normal prosecutorial discretion that happens every day.  Just because some sheriff is butthurt that his police officers look bad because they roughed up a couple for driving while black and arrested them purely for resisting arrest doesn't mean dereliction of duty. It just means that the cops are assholes and the case would have been lost in front of a jury anyways.

Keefe, who took the stand later in the day, however, provided some of the most illuminating testimony, saying he was the "primary driver" in getting Warren's suspended. His inquiry started in the wake of DeSantis asking during a December 2021 meeting whether there were any Florida prosecutors not enforcing the law.
Keefe contended during his testimony that Warren was "crossing the line" for signing the statements on abortion - and another one saying he would not prosecute anyone for providing gender affirming care to transgender patients even though the state does not have any criminal laws dealing with that. Florida approved a rule banning gender-affirming treatment for minors several months after Warren was suspended.
"This wasn't a one-off," said Keefe, a former U.S. attorney who also directed the DeSantis administration's contentious relocation of migrants from Texas to Martha's Vineyard. He said this statements regarding Warren were part of a "very problematic" trend from the ousted prosecutor. "I absolutely believed he needed to be suspended."
But Keefe acknowledged several times on the stand that he never called Warren directly or communicated with anyone in Warren's office to ask about the prosecutor's statements. Warren and two top officials still working in the state attorney's office said there wasn't a blanket policy against prosecuting abortion or gender-affirming cases and they have not handled any such prosecutions. Warren's team even noted a written policy that tells prosecutors to evaluate individual cases.
Keefe, who said he conducted a review of Warren's actions but not an actual "investigation," brushed aside the written policies. Instead, he contended that Warren was a "state attorney whose approach to his job was harmful" and that he was antagonistic to law enforcement, an opinion based on conversations he held with several people, including the current Hillsborough sheriff and the former Tampa police chief.


This is not so much documented behavior or dereliction of duty so much Keefe going by truthiness, to the point where you'd think what he was doing was out of vengeance or spite.  Considering he is the asshole responsible for directing the human trafficking from Texas to Martha's Vineyard, I'm inclined to believe it was spite.

There was a time, not so long ago in the grand scheme of things, when stuff like this would bring any politician down. Not any more. All we're doing is finding out how utterly terrible the GOP is, and how utterly terrible their voters are...they don't farking care, in fact, I think they reward the shiatty behaviour because it makes people like me mad.

Citizens United got a federal law passed prohibiting corporations and unions from making expenditures in connection with federal elections.

(that's a good thing for everyone)

Warren made a comment about not enforcing laws that weren't and aren't even on the books yet. There's no way he should have been fired for this. It was clearly retaliatory on DeSantis' part. He deliberately finds ways to punish anyone who defies his often unconstitutional authoritarianism.

Except no examples of the prosecutor NOT enforcing the law, even the one where he signed a petition from an outside group. He was fired because he publicly spoke out against the governor's red meat, not needed, and no point law. It was known he didn't agree and the people that elected him did so BECAUSE he didn't agree with policies like felony farming by the local deputy sheriffs. It was the refusing to prosecute the upcharges from stopping people for non-arrest offenses like loitering, jaywalking, public intoxication and ending up with 20 counts of resisting arrest (hyperbole at the number of counts, the point is when the officer would choose to interact with someone for a ticketing offense, the officers would escalate the situation to achieve an arrest instead of a civil infraction)  that raised the ire of Keefe. This was pure political hit job as stated by the pomp and ceremony of announcing the suspension and the "prepare for liberal tears" twitted out by the governor's press secretary. I agree sometimes the governor needs to step in and suspend an elected official and Governor DeSantis knows when and how to do that properly like the Bravard County Sheriff following the Parkland shooting. This was pure pandering for re-election and since this and other stunts have worked to energize the base and the potential consequences for them didn't happen before the election this is another success.

I do not believe that this was retaliatory by DeSantis. I believe that DeSantis stages political theater to make himself appealing to right-wing social warriors and this was a theatrical way of appearing tough and creating a target and scapegoat.

I don't think this had very much to do with Warren. He was just a convenient target. DeSantis' very question to his lackey "Are there any prosecutors not enforcing the law?" shows that DeSantis was seeking out a target.
