Carroll was waiting for new state rules in New York to take effect that would provide her an opportunity for legal action despite previous restrictions derived from what are known as statutes of limitations.

I'm surprised they allowed that new law to be retroactive.  I mean, good for her, I'm just surprised

That is of weird.  Normally for things like this, they would grandfather old cases.  Is there a constitutional principle related to that?

She seems smart as hell in the interviews with her I've seen.  She probably doesn't have unrealistic expectations but she's standing to a bully and no doubt suffering death threats from the cult so that makes her a hero in my books.

They didn't retroactively make what he did illegal, it was illegal when it happened. So I guess that's the difference. They just removed a limitation on when it could be prosecuted.

He can't. This happened before Trump became president. He denied the rape while president, so that got the DOJ to back him. It's out of their hands on this new case.

Generally speaking you can't retroactively make something criminal, but they didn't.  It was ALWAYS criminal, they just removed another law that said, "Well, if you got away with it long enough, we give up".    You can decriminalize something, though.

I'd expect lawyers to argue that it's not a criminal offense to get away with a criminal offense, and it's just been criminalized, of course, but I'd kind of hope they don't win with that argument.   If the original action shouldn't have been a crime, it would have been decriminalized.
