There is a tiny possibility there might be more to this story.

Like this canvasser was allegedly hired to thoroughly roger Rubio with the extra-large can of tough-actin' Tinactin every night at midnight whilst singing the refrain to "Masquerade" from Phantom of the Opera while a bobsled team of shaved Indonesian twinks wear Obama masks and aggressively fart into jars Rubio will carry with him on the campaign trail, stopping between speeches to inhale deeply and recite the Pledge of Allegiance.

Knowing these facts that the Rubio campaign has not disputed and which have been printed on the internet, sadly last week said canvasser lost his grip on the Tinactin can on a particularly vigorous downstroke, resulting in a trip to the same Republican doctor chained in the basement at Mar-a-Lago that installed Trump's gold-plated ostomy supplies. The procedure went poorly, so a rock-solid alibi was crafted, an alibi that could not be repeated in court.

It's almost *too* simple.

You aren't totally correct. The fifth amendment precludes you from being forced to incriminate yourself. Pleading the fifth is literally standing in front of a jury saying "I refuse to testify about X because my testimony about X could be used to prove my guilt."

Why would being under oath affect what these dipshiats are willing to say, and where they are willing to say it?  Oh no!  Perjury!  Well, that's a bridge too far for me. They've pretty much gone all-in already.  It would only matter if there was *proof* that they are lying - and if there is proof, who the hell cares what they say?

i remember something my first boss taught me, and it still holds true to this day.  "anyone who presents themselves as a christian business man, is the first guy who will screw you over given the slightest chance"

The attorney for one of the alleged attackers, Jonathan Casanova said that the fight actually happened as a result of a "testosterone-filled fisticuffs because Monzon was staring at his client's girlfriend," reported the Herald.

The jury will need to examine said girlfriend in a swimming suit and cheerleader outfit to determine the likelihood of rage filled jealousy and whether a fight was warranted.

The video appears to show that Lopez was the one backing up away from Monzon.


So the "canvasser" was told to leave and THEN trespassed to assault some people? And the guys defending themselves were being held in jail until now?

Yeah, that's not a basis to invoke the 5th amendment. You invoke the 5th when the answer to a question may incriminate you ... not because you were unconscious and unaware of [whatever].

Yes. But it's unusual for a prosecution witness to start pleading the 5th.

He's not accused of a crime.  He's the accuser in a criminal case against another.  The 5th is a right that a defendant can exercise without any judicial prejudice.  However, if you take the 5th as an accuser, it's not going to go well for your testimony against another.  Both the judge and jury are likely to set aside most - or all - of your claims if you're invoking the 5th as an accuser.

Also, there is a LOT wrong with taking the 5th in a civil case (which this is not, but your statement is far too blanket).  In civil cases and depositions, taking the 5th will nearly always result in the judicial assumption that the answer would have been against you, and it will be weighed as such.

You are right.  And while I am not a CD lawyer and this is not legal advice, I think there could be grounds for claiming that it is an invalid invocation of the Fifth because you are qualifying it with a factual assertion.

My understanding is that you refuse to testify period.  If you add some qualifier, that acts as a potential waiver.  For example, you obviously can't claim, "I choose not to answer this question pursuant to my Fifth Amendment rights because I wasn't at the crime scene at the time in question."  This seems to me to be in the same boat.

However, since there is no chance I will be on any jury, I am fully permitted to infer from his plea that he is guilty as all fark.
