What scholarship! The entire video is cribbed from Wikipedia and nothing else. It even includes the last line.

https://en.wikipedia.org/wiki/Nix_v._Hedden
In 2005, supporters in the New Jersey legislature cited Nix as a basis for a bill designating the tomato as the official state vegetable.[6]

Botanically, a fruit (it's got seeds). Gastronomically, a vegetable. You wouldn't put tomatoes in a fruit salad.

I don't know what this is about, but I have the following to say...

Botanically a tomato is a fruit.  But in culinary use, it's a vegetable.

Technically, it's classified a berry.  Like bananas and some other weird ones I don't remember.

It's a fruit that generally treated like a vegetable in cooking. And it doesn't matter what the SC says; science doesn't give a crap what lawyers say.

...zucchini, watermelon, and potato are the fruits that I like to point out are berries.

I remember a conversation with my ex.  She's saying that I need to eat more veg, and I said "well potatoes are my veg".  She didn't correct me, therefore potatoes are veg.

With the exception of leafy greens and root vegetables, everything has seeds. I think that was the definition argument they were trying to make.

"Vegetable" is a culinary definition, not a scientific definition.

Some culinary vegetables, like mushrooms, aren't even plants.

You wouldn't want to eat a potato berry in any case.  They are poisonous.

At one time, tomatoes were considered poison.

It is a good thing that this is not law and not science.

As an English or linguistics major might point out, context is everything.

Are you an animal? It depends if the context is law or biology.
