My local bike shop went through that with the local government, and it's just art on a building you can see from the highway

In Jersey, that exception is going to cost more than the $1500 to repaint it. Probably involves taking a trip out to the Pine Barrens.

It's a sign. It's a cute sign, and it doesn't have words, but it's a sign. If a Wendy's put up a sign that just showed Wendy but didn't say "Wendy's" it would still be a Wendy's sign.

Presumably businesses in that town are allowed to have signs, but they have to follow rules, which probably include getting prior permission. They can change their sign to qualify as artwork, or they can follow the sign rules.

better, maybe even correct to say, mural not artwork.
the city may not define what art is or is not, commercial art anyone?

but they likely would define that a mural is not an ad.
and so nothing that wanted to claim to be a mural could include registered trademarks, mascots, company logos, etc.
and a business that wanted to display a large permanent ad to the public would be a different kind of permitting to seek.

No, it's a billboard. They can put donuts and sprinkles there, but their corporate mascot makes it an ad.
