I'm still a little disappointed that the people who were in the military/reserves when they attempted a coup are not facing a military trial and pubishment.  I guess I don't know what the rules are exactly about jurisdiction, etc., but don't they specifically take an oath about this? Does their binding code of conduct explictly mention not working to subvert the gov't?  He's asking for the end of his military career to be factored in as a mitigating factor of sorts, but it really seems like all that is is him escaping a harsher trial and sentence on one arena and then saying "poor me" about it in another.

What annoys me about all this is that I know a guy who burgled a safe from a commercial establishment and got caught - he avoided prison but spent about a year in jail (jail is not prison, he would explain) and then a year on house arrest. Literally could not go out, house arrest.

These guys tried to overthrow the government. They sacked the capitol building and forced congress to hide out. And they aren't even getting prison time? Martha Stewart served longer.

IANAL, but my understanding from experience is typically they'd have to be on orders to be under the jurisdiction of the military.  If they're traditional guard/reservist then their one weekend a month/two weeks a year or if they were activated for some other reason.  Otherwise they're civilians for the most part.  I'm sure there's something in the MCM that spells it out.

Not two months.  59 days because he would have lost his military disability payments.
Judge right there should have made it 61 and followed up with the DOD to make sure he lost those benefits.
After all, defendant tried to overthrow the government.  If he hates it so much he shouldn't mind losing his communist welfare from groomers.  No doubt he's arranging an exemption to social security and Medicare while on his home detention, right?

I would expect members of the military to be held to a HIGHER standard for crimes like committing insurrection, but instead of that we get "Pwease don't take away the military benefits that make my lifestyle possible and that are 100% provided by the government I tried to overthrow."

Judges allow it all the time, and it's bullsh*t.

There is no place in the country where you get jailed for 10 years for having weed, unless you are a three-time loser with a gun who was moving around literal bales of the stuff. I'm sure this guy did plenty of other bad shiat without being completely stupid about it.
