The judge didn't find that to be sufficient punishment, and she also indicated that Jonathan Toebbe's sentence under the deal fell short.

"Counsel, it's not in the best interest of this community or, in fact, this country to accept these plea agreements. Therefore I'm rejecting them ... I don't find any justifiable reasons for accepting either one of these plea agreements."


These clowns knew what they were doing was espionage at the highest level. And yet they persisted...

However, it's not treason.  A treason charge only works during wartime.

During January 6th.

But for plea agreements, our entire court systems would collapse in a matter of days as the would be noway to keep up with the trials.

Judges/courts aren't bound by agreements between the parties, though most of the time the agreements are honored. See above.

In this case the court disagreed with the leniency being shown so  the agreement was rejected. The defendants can negotiate for something else or try can go to trial. Nothing unfair about any of it.

17.5 years for trying to pass off confidential documents and 3 years for going along with it doesn't seem that weak to me. Now if it were top secret and the guy had been in any way successful, sure. But not all espionage is created equal.

Though I'm fine with them getting the chair if we can apply the same standard to the orange guy.

On one hand, crypto.  On the other hand, it was absolutely and entirely designed to evade government monitoring and seizure.  I'm kinda torn on this one

I do wonder what Trump's reaction would be if he saw it. Would he shiat himself with fear? Be too dim-witted to even know enough to that he :might: face consequences? Or is he really convinced that he is beyond the reach of the law for anything up to (and maybe including) murder or being an actual slave-owner?

Put a pin in the fact that selling confidential and not SCI is worth more than 17.5 years.  Put another 1,000 pins into lookouts and basically people with knowledge of the crime is worth more than 3 years.  Put. A. Pin. In. It.

Oh you didn't hear that the FBI raided Mar-a-lago and confiscated a bunch of top secret and classified documents from Trump. I'm surprised that you missed it. It was pretty big in the news

In a series of dead drops in West Virginia, Pennsylvania and Virginia, Jonathan Toebbe passed military secrets to someone he believed to be an agent of another country, but who was actually an undercover FBI agent, authorities said. In one of the exchanges, he concealed a memory card inside a peanut butter sandwich, according to court filings.
Diana Toebbe admitted that she acted as a lookout for her husband at prearranged secret locations as he deposited classified documents that would later be retrieved by the FBI.

When you take a plea bargain you're doing it with a prosecutor. They promise to make a sentencing recommendation but it's always the court that has the final say. I'm sure their lawyer explained the situation to them before they plead guilty.

Yeah the judge shouldn't have this authority.  There's a reason a deal was even offered, If it goes to trial they may get zero.  Any evidence collected as a result of the confession should be now excluded.

The FBI has not disclosed how it obtained the package, but the New York Times reported Brazilian officials alerted the FBI after receiving it.

You can't possibly expect to get away with espionage when you involve that many officials.

No evidence was collected after his confession.
His entire career as a spy was providing documents to an FBI agent before he was arrested.
His confession is meaningless.

What about when we find out that what the FBI took back was just the stuff that hadn't been sold yet? He started giving it away for free just a few months into his administration. Like most dealers, a free taste to get them hooked, then full price for the good stuff.
He didn't force that security clearance for Jarrod for the benefit of our country. Somewhere, there has to be a list of the documents that were requested by the Real Boy. All Classified documents have to have chain-of-custody records.

He failed the first step, which was establishing the bonafides of the other party.  If he chose Brazil then I expect that neither what he was offering was interesting to them, nor were they willing to jeopardize relations with the US over something that they could probably get by sending a few bright prospects to study at prestigious American engineering universities.

If either had been Brazilian then the US might not have pushed the operation to this extent, but if he was willing to sell to a somewhat random other nation, he might have been willing to sell to other nations too, including some much more hostile than Brazil. Hence the major operation to run him until he was caught dead to rights.
