Trademarking common phrases and common names just shouldn't be allowed. Kylie Jenner is welcome to sell as much makeup or clothing as she likes, but trademarking decades-old colloquialisms like "Rise and shine" (which she did) or attempting to trademark the name Kylie (fortunately failed on that one) is just bullshiat.

Call yourself the Queen of Christmas if you want to, just don't sue someone else for doing the same farking thing.

/she basically declared war on Australia when she tried to trademark 'Kylie'. She's widely loathed down here for that one.

I love that story. She failed on it primarily because Kylie Minogue went "Uhh... what the FARK???" and threatened a whole bunch of legal action in response.

So looking at the USPTO's reasons why it might reject a mark, it will most likely be

"matter which may disparage or falsely suggest a connection with persons, living or dead, institutions, beliefs, or national symbols, or bring them into contempt"

Given that Christmas is primarily a religious festival I think this would constitute a false connection with a belief.

Also the US Constitution says in Article 1, section 9, clause 8: "No Title of Nobility shall be granted by the United States".

I don't even know either of these women's names. I guess I know 1 song by Darlene (Baby Please Come Home) but had no idea that's who did the song. 

It's kind of hard to call yourself the Queen of Christmas if your people don't know your name... Meanwhile, like it or not, Mariah's been ruling that roost for decades now. 

And this whole nonsense about Letterman declaring her Queen of Christmas a full year before Mariah's big hit came out isn't as persuasive as one might think given how iconic "All I Want for Christmas is You" has become... Which means that, sure... You had the title for a year... But someone stole your crown and you never got it back. 

Elizabeth Chan... Who? Looked up some of her music and I've not heard any of it so far as I'm aware. So, despite her impressive catalogue of christmas music, she's coming of as the Xmas music equivalent of MGK trying to go after Eminem. It's farking embarrasing.
