Plaintiff specifically told Defendant Tillman that she had a seizure disorder and restrictive lung disease. Id. at 9. Defendant Tillman nonetheless remained on top of Plaintiff, and she subsequently had a seizure. Id.

In lieu of an arrest, Plaintiff was given citations on charges of misdemeanor obstruction and criminal trespass - family violence.


/ Amazingly, this is one of those rare cases where the court entirely denied the officer's claims of qualified immunity.

Officer Twitchy should have been referred to POST for a Certification review (It DOES happen sometimes with these situations). But don't worry, even if he does quietly resign from Clayton, he'll show up somewhere else.

At this point they might as well clock in, sign an affidavit that they believe they are in danger for the entirety of their shift, and then go about their business. That way everything is covered. No need for silly testimony in cases like this - it's already in writing.

In a just world, that cop would be looking at a 4-20 year prison sentence for breaking and entering and assualt. Police have no right to enter a house without a warrant and that violation right there should be enough to end any officer's career permanently.

happened in Virginia a few years back. Cops made a no-knock raid on a known criminal. Criminal used a firearm to defend himself, thinking it was a bunch of other criminals pretending to be cops (this was a reported phenomenon at the time). Three cops shot, one died. Cops charged criminal with aggravated homicide.

No two ways about, the shooter was a known shiatbag. Very few redeeming qualities in his lifetime of antisocial behavior, and lots of time behind bars.

Jury acquitted him of all charges related to the police raid on his residence- specifically for the homicide charges and assaulting an officer charges. He still went to prison for the original criminality, but the Virginia jury didn't buy the cops' claims they properly announced themselves (non-criminal neighbor testified they didn't).

It was a horribly sad set of circumstances, but a buddy and I giggled over his auto insurance dropping when he married his live-in pregnant girlfriend, and again when they birthed the child that died minutes after birth. "Well, on the bright side., they cut my insurance rates again..."

(They had to have been remarkably high as he'd totaled a few cars as a teenager.)

They should train him to stand guard at the sewage treatment plant, next to the first-stage of treatment at the solids separators.  After all, someone might fall in.  And give him just an open, roofless golf cart for his patrol vehicle.

That's the way it should be. When serving a no-knock warrant, the person on the other side doesn't know who is breaking the door down. Why would anyone assume it is the police rather than a wouldbe robber?

ALL charges relating to the raid on his residence were acquittals- even 'resisting arrest'. Jury found the cops did not identify themselves, and any actions taken by the shiatbag were considered justifiable self-defense.

Wow. As much as I would like to believe that this is an example of LE doing the right thing, I have to wonder...

True that. I was remembering later--based on the HS GF I was dating and how old we were-- he was probably 21 at the time of the loss, his girl bridging 18, him holding a pretty good job--and he'd grown out of fast cars.
