Oh he's farked, (It means that they've added even more charges in a nutshell. Which means that they feel their case is even stronger than when they first brought it to the court.)

I hope so.  He's got 2 charges of actually getting violent and this choad needs some prison time.

I wish the article explained what he was alleged to have done to have those extra charges. Most of these insurrectionists are getting a few months or time served. What did this guy do that could get him almost 40 years?

Yeah, well, if not for the damn libs, he would probably have two vineyards.

Send the J6 terrorists to Gitmo for "enhanced interrogation" about their leaders, and a trial by military tribunal. Any that are convicted get a short drop with a sudden stop.

If you're this deep into the Insurrection judicial process, it means the Feds have done a heck of a lot of investigation on you and will easily bowl over your "I didn't do anything wrong / you don't know nothing about the law or Constitution" defense.  Enjoy your Federal prison toilet wine.

A) On my initial scan of this article, I automatically inserted an "n" into his name. I'm pretty confident I won't be the only person who did this.

B) Someone already mentioned the name of his vineyard. If you want a better look: https://www.kissingtreevineyards.com/. Seems well reviewed at this point.

Imagine how twisted and bitter you must become trying to produce in wine in Texas of all places. First, the landscape is against you entirely, between the droughts, heat, and lack of appropriate terroir. Then, after years battling the elements in the Texas heat, you finally produce a passable beverage, only to realise that you live in Texas, a place where Real MenTM only drink cheap beer.

Federal Felony Murder statute is fairly narrow, closest charge to J6 is Treason.
In my state, everyone who went into the Capital would be guilty of 7 counts of M1

He's a white male Republican in Texas. I bet if you actually went to visit his "Vineyard", you would discover it to be mostly dirt, more dirt, couple of buildings, more dirt, and a warehouse to resale other people's wine.

There's a reason why it was called The Business Plot when they did it nearly 100 years ago:  it was led by the same sorts of people who already had everything and were just super-pissy that poor people might get some of it.

That's part of it but more importantly...

lawpeeps tell me if I'm getting this wrong

...a superseding indictment means a bunch of other things have happened. Another grand jury was convened (though not necessarily specifically for this dude) in the same judicial district & possibly by the same judge who's hearing the case.

I suspect the judge (this time definitely the same judge) also has to grant a motion to add the charges to the current trial. The defense can oppose any motions, & so the judge would likely have deliberated on whether to add the charges at that time. So if the judge were likely to be willing to dismiss the case, she or he would never have allowed the superseding charges to be added to the case in the first case.

No. It means he wont cop a plea so they are trying to strong arm him into taking one. I agree with the defendant fighting these charges if there is really no evidence to sustain a charge like if there is no video of him hitting a cop then he probably shouldn't plead guilty to that.

His judge is Kollar-Kotelly? Good luck with that, jerkwad. He is liable to get spanked for even filing the motions, if the judge feels they are frivolous.

Neat bit of viticulture history: American native grapes are resistant to phylloxera insect pest since the pest originated in the Americas. So when that bacteria was killing grapes around the world, vineyards moved to use American root stock for their vineyards and then grafted the traditionally grape plant to the roots. The French relied on the expertise of Thomas Munson, an immigrant Texan who had extensively studied native Texan grapes. So yes, Texas sucks. But it did contribute something to the world.

Here's a fun writeup.

In general, the closest applicable thing everyone got to is felony burglary.  For felony murder to apply you'd have to prove that the person you charged with felony murder committed the same burglary as the person who caused the death.  And you'd have to prove that the person knew there was a risk of death with the burglary they participated in.

To me, you burgle, you see the violence, you stay, someone dies, you felony murdered.  I'm sure much easier said than done.

What's mildly surprising to me is that a lot of the terrorists in 1/6 were middle-class to wealthy. Sometimes they're painted as lower-class losers but there's a lot of money going on there. I guess that's how they're able to travel the country attending rallies. It's like the Grateful Dead but more seditious.

Prison. Long time. I'm sure that his family will keep his Commissary account flush. You wanted to be like the Founders, and they were facing sedition charges if they lost, and hanging. You're not facing hanging, so maybe you'd like to STFU and put your principles where your mouth is.
