Sure, this just sounds like the traditional commission process artists have used since forever but I promise that my artwork will be as lazily produced as possible and will be thoroughly uninteresting.

Fun fact, Bored Ape Yacht Club might not actually own the copyrights on their NFTs.

Only art created by a person may be copyrighted. Art created by randomly assembling elements without human supervision don't count, even if you own the copyright on specific elements. Which means the composition as a whole might be public domain. (Unless the copyright on those specific elements was really, really strong.)

That's why this is being filled as a trademark lawsuit. Trademarks have a completely independent set of laws.

Unfortunately I don't know any trademark lawyers who have weighed in on the subject.

Oh hey, I misread that. The new NFT happens to contain a link to the actual Bored Ape Yacht Club image server.

Hyperlinks can't be copyrighted or trademarked. Like telephone numbers, they are mere facts. And anyone can publish a book of publically known facts.

So unless these new NFTs have terms and conditions that imply some sort of ownership over the images, this is going to be a really hard case to win.

This is gonna be fun to watch.
