Nothing good is going to come from eroding the barrier between church and state.  The courts will find more and more convoluted ways to separate "real" religions from "fake" ones.

The below summary comes from a decision by a Master of the Queens Bench of Alberta, Canada. A Master is a judge in all but name whose role is deciding preliminary motions in civil matters. The Master involved, Master Funduk, is noted for his witty judgments. The Queens Bench is the trial division of Alberta's highest court. In the Canadian system, the highest court of any province is always the province's Court of Appeal, even if the highest provincial trial court is called the Superior or the Supreme Court of the province. Here's how Master Funduk summed up his role (some paragraph breaks inserted):
Any legal system which has a judicial appeals process inherently creates a pecking order for the judiciary regarding where judicial decisions stand on the legal ladder.
I am bound by decisions of Queen's Bench judges, by decisions of the Alberta Court of Appeal and by decisions of the Supreme Court of Canada.

Very simply, Masters in Chambers of a superior trial court occupy the bottom rung of the superior courts' judicial ladder. I do not overrule decisions of a judge of this Court.

The judicial pecking order does not permit little peckers to overrule big peckers. It is the other way around.

LOL at Citizen United.  The idea the 1st Amendment covers the expenditure of money.  The logic of that farking thing is non-existent and flatly contradicts  Article 1, Section 8, Clause 3 that gives congress exclusive power to regulate commercial activity: aka spending farking money.  Which is neither expression nor speech.

From 20,000 feet it does seem that the great moments in supreme court history used to involve colossal issues argued by legal titans and decided by the best the legal profession could stuff into a supreme court robe.

Today mediocre lawyers argue faux outrages to middling conservative justices who are too lazy to even do the basic homework on the cases before them since they've pre-determined their ruling based on seeing themselves in a culture war.

It's hysterical when these judges like Thomas whine about lack of respect for the court.  Nobody exemplifies the lack of respect for the court more than the six justices currently in the majority that have no business in those seats.

The coercion is the point. One of the underlying principles of right wing ideology in the US is the idea that freedom is only possible with a population that is self disciplined according to "traditional values." They envision a world in which there is the written law which only weakly constrains people (at least straight white men), and a system of social pressure which is basically bullying anyone who diverges from a set of unwritten rules that maintain social hierarchy and define social and gender roles so that everyone knows their place. Without the bullying there cannot be freedom under this worldview. It's crazy and stupid, but it's a dearly held belief among the people who believe in the mystical America that's specially blessed by a god who bestows manifest destiny and American exceptionalism.

The people who believe the constitution is divinely inspired (like the dude at the 1/6 hearings the other day) along with the other mystical nationalist claptrap tend to strongly believe that bullying is a necessary element of a good society. Informal methods of suppressing deviance mean the government doesn't have to do it. The idea that nobody needs to do it at all is beyond their ken.

I'd take that bet - if someone was abusing their position as a public school employee, using public facilities during a public school event to actively encourage students to engage in Muslim prayers, the ruling would not be 6-3 against.

The ruling would be 9-0 against, with three justices on the side of religious freedom/no government-sponsored/forced prayer, and six justices on the anti-muslim side.  They might line up in the end result, but they'd get to the same spot.

That's a the ACLJ (not ACLU) does.

I recently prevailed at trial (which should have been dismissed years ago on my motion to dismiss) in a case that lasted 6 1/2 years.  The plaintiff, a right wing housing developer, sued my client because my client (a public housing authority) wouldn't violate a HUD regulation on the disbursement of project based vouchers.  See, the plaintiff wanted us to just give them the vouchers, so they could take them to a financing agency, get tax credits, and millions in below market rate interest loans, and a guaranteed income for their for-profit company for 15 years.

When he housing authority said that it would violate federal law if we just gave them the vouchers, they sued us for discrimination against disabled veterans. Even though there was nothing in their request that even mentioned disabled.

What they wanted was to be able to win, take that judgement around the country and force governments to provide them no-bid contracts under the guise that they were helping "disabled veterans" and if you actually followed the law, and refused a reasonable accommodation to provide the for-profit company free, no bid contracts, you were discriminating against "disabled veterans". Please note that at no time did they ever present 1 disabled veteran who planned on living at their future development.

Thankfully, the jury saw it for the bullshiat it was. It actually took them longer to fill out the verdict form than it did to come to their verdict . Jury foreman said they made up their mind in 30 seconds.

The right does this crap all the time. They just find, or make up what they believe to be a sympathetic plaintiff.

Republicans are already sponsoring a bill that gives fetuses personhood and tries to give them equal rights under the 14th amendment, making all abortion murder. It's that ridiculous.

Mind you, if the fetus is a person, it's in a woman's body against her will, and in their own stupid logic, she should have the absolute right to defend herself, with lethal force if needed.

/it's not an abortion, it's "stand your ground" and castle doctrine.

This Gang of Five that has taken over the court know exactly what they're doing. Well, maybe not Handmaiden and Beerbro, but they know that there is almost nothing that can stop them. They have lifetime appointments. They can stay in session as long as they decide they want to, reviewing laws at whim. This whole opinion writing is just to please the bean counters at the ABA. Stare Decisis be damned

They could toss Marbury v Madisonor Brown v Boardjust for shiats and giggles and there is nothing to stop them.

Court Expansion and a whole lot of new Amendments - a modern bill of rights as it were - are the only solutions that exists under the Constitution. I don't think the drafters of the Constitution even imagined a Supreme Court that would act as reprehensibly as this court has acted.

I again ask anyone out there to PLEASE tell me if I'm wrong on this.  I really don't want to be right.

I have nothing to offer other than I hate Republicans. I know it's probably ignorant on my part but they seem to want to hurt people. Simply hurt and harm people. And kill people , like for fun. They seem like psychopaths..
