I don't see how this is any different from a pharmacist refusing to fill a woman's prescription for abortion pills or birth control. If that's allowed, this should be.

Conservatives already have a track record of immediately attacking anyone who even facetiously threatens their perceived God-given right to healthcare, even as they speak out of the other side of their mouths to insist that healthcare is not a right.  They love their righteous indignation.

Like the medical student who was mocked by a patient for wearing a badge stating her pronouns and then very vaguely implied that she missed an IV stick on purpose. (Not surprising, the top 3 links to that story on Google come from right wing news sources trying to claim an anti-woke agenda)

Or the non-clinical cancer center administrator who was fired over private Facebook messages facetiously arguing that Trump supporters who don't believe in COVID should voluntarily give up their ventilators (The hit was carried out by Michael Caputo, the exact same Republican/Gazprom operative who later was given a job in HHS where he actively tried to suppress COVID data)

Hospitals need to start standing up for their employees and stop taking this shiat seriously.

This nurse is going to be fine.  By next week she'll be traveling and making three times what she's making now.

The difference is slight. Refusing to fill abortion pills or birth control is not illegal. It also shouldn't be illegal to fire people for not doing their jobs like that. Refusing to serve based on race is illegal and this woman should be prosecuted for it

Not really. They issued a technical ruling about standards of proof for mens rea that affects acceptable jury instructions in the specific example of the Controlled Substance Act.

In effect, the State still has to prove the MD prescribing the drug knew they were doing something wrong, knew beyond a reasonable doubt. You can't just assume they knew it was wrong because of generally presumed professional standards. So it's not about what they felt, but what they knew.
