Eastman disclosed the search and seizure in federal court in a lawsuit that he filed in New Mexico on Monday, calling it improper.

In court, he is asking a federal judge to force the Justice Department to return his property, destroy records they've obtained and put on hold investigators' access to the phone.

If what I've read in the past is accurate, the burden to obtain a warrant on a lawyer is very, very high.  The burden for a warrant on the lawyer to the former sitting president would be extraordinarily high, probably the highest there is other than possibly lawyers working on behalf of foreign countries who've registered as agents.

If a judge signed off on this warrant, it's going to survive his challenge.  The only thing that he could have done to have protected himself was to have set up a data-retention policy that automatically deletes e-mail and other electronic communications after a set period of time, like when the message is a year old and not specifically flagged for longer-term retention.  Because then he could use that as a defense to a charge of destroying evidence and ask why if what he did was allegedly so severe that they didn't come calling within a reasonable period of time.

But I don't expect these to be smart guys, and that he probably did have stuff on or accessible through his phone that is incriminating.

I was under the impression that courts held that a password was protected, but things like an image-based unlock or other biometrics are not protected.  Because one is something that you have to give up, the other is ... simply you.

The news in all this is that the Inspector General was involved in serving Eastman's warrant. And (according to Lawrence O'Donnell and some  of his guests tonight) would only be needed if he had a connection to someone inside the DOJ. And from there, the phone was delivered by the IG to the FBI. So, the DOJ and FBI are involved, which for sure makes this a criminal investigation.

And Eastman does a known connection inside Trump's DOJ. Jeffery Clark. And they seized all of Clark's shiat the next morning after they got Eastman's phone.

Side note: O'Donnell thinks that the surprise witness could be the voice of one Donald J. Trump.

And yeah. Trump is dumb enough to be recorded, or yes, even leave a voice mail that could be used against him.

The thing is, they don't NEED his phone. They can get all the info they are looking for from the cell providers and apps. They most likely already have it. This is just a stuck pig squealing

He was patted down, and "forced to provide [facial] biometric data to open" the phone, Eastman's court filing said.


That's closer to a key than an actual password
