You know what, after reading the comments above I decided I don't care if it has a fat chance of doing something. I want a fight. I want them to constantly be inundated with lawsuits and people harassing them. I don't care about Republican feelings. Does this have a chance of being successful? Maybe an extremely thin chance. But I absolutely want her to pursue it. I want others to fight too. Anyway possible.

/Before you say it, we don't.  Even with the 2 Independents, we have a 52-48 Republican Senate on anything that Republicans think is important.

Yeah, at one point I really wanted the full on throw the book at 'em legal fight too.

It's wasted effort.

They have no shame.

They won't convict their own.

They will flip the script and impeach and convict Dems for the most minor of offenses.

They want to anger libs until one snaps and does an Oklahoma City on RNC HQ or something.  A farking mass murder shooting at CPAC.  I dunno.  Something where they can finally claim libs are a serious threat and then declare martial law and install Trump as President for Life after the civil war kicks off.

OK, they've got better lawyers than this poor sonofabiatch whose story ended up in a clickbait/meme, but if you operate from the principle that the process is the punishment, the insurrectionists still have to deal with the ritual of the perp walk, being photographed in prison duds, and images of them in handcuffs as the first results returned by a google image search.

The DA might care about the conviction rate, but the cop doesn't care, he just wants to make someone miserable. Investigate, file charges, issue warrants, and arrest.

Someone gotta problem with dat? What, you got some kinda lack of faith in the legal system?

Someone gotta problem with keeping 'em in jail as a flight risk until $10-$100M in bail is put up? What, you think the courts don't give erryone a right to a speedy trial?

Someone think a not guilty verdict in mid-2027 when it goes to trial in 2025 is gonna look bad? What, you got some kinda problem with dotting all the Is and crossing all the Ts to make sure the processes are followed to ensure the defendant was given adequate time to prepare their defense while incarcerated waiting trial?

If a hostile adversary can use a distributed denial of service attack against the rule of law by COMMIT ALL THE CRIMES / FILE ALL THE BULLSHIAT LAWSUITS so rapidly that the justice system can't keep up with the paperwork, why can't proponents of the rule of law return the favor by CHARGING ALL THE CRIMES so frequently and overbroadly that the accused is compelled to seek a plea bargain?

If that sounds repugnant, let me remind the audience that this is already what the justice system does to people who are still subject to the law.

With the legislature effectively neutralized (60-vote requirement to pass anything in the Senate vs 67-vote requirement to override Biden's veto regardless of which faction controls the House) for the next three years, there's a bit of a power vaccuum. The fight for power over the next three years will be fought between the executive and judicial branches. The executive decides who gets targeted by the laws, and the courts get to decide whether the laws are more important than the targets or vice versa. The first faction that grasps the concept of applying "the process is the punishment" to those who are presently above the law gets a potentially-decisive advantage in that fight.

Further, saying that Roe was settled precedent, or any ruling, doesn't mean you'll never reconsider it. It means on cases that don't directly challenge it, you will apply it. No sane and literate person could read their words and read that as a promise to never over-turn that settled precedent.

This is a dead end and waste of energy. Focus your energies where they can do some good, especially at State level politics where there are zealots who will try to make all abortions illegal, remove access to contraception, and attack marriage equality.

Seriously, while I agree with her assertion that candidates for the Supreme Court should not be able to blatantly lie during their confirmation hearings with impunity, this has about as much of a chance of success as getting Rupert Murdock to donate his entire net worth to Planned Parenthood. All it will do is waste a bunch of time and energy, and give the GOP some annoying "oh look how mean they're being to our precious justices, and all because they didn't get their way" talking points.

If Congress passed a law to protect the right to abortion, or to marriage equality, SCOTUS would invalidate it under the 10th Amendment. It was critical that these rights be established as having a Constitutional basis, not a federal statute. By virtue of having a Constitutional bases, the Supremacy of the Constitution prevails. If just a Federal Law, the 10th Amendment gives the power back to individual states. That's just the facts.

So when you see the usual suspects trying to lay this at the Democrats feet for not passing some laws to protect these rights at the Federal level, know that it really doesn't work. In fact, it just gives SCOTUS another avenue to revisit the Constitutional basis of rights, which currently they won't do if the right isn't explicitly enumerated.

how many times was there an appeal of Obamacare?

heck, the GOP even tried it a few times knowing it would go no where just so some newly elected GOP members would have a chance to vote to "repeal and replace" it.  again, knowing it would never pass, they still did it tens of times and think of Bengazi.

There's already going to be a wave of rapes, incest, stillbirths, and miscarriages because of this. it wont work as they need 67 senators but it could get enough people to the polls to hold the senate. i still have the dems at 75% of holding the senate with at most 52 (pa is flippimg and wi looks likely as well.  oh is a maybe)
