Tyranny of the minority.  Just like the US Senate!

if you add up the population of states and assign half to each of their two senators, "the Democratic half of the Senate represents 41,549,808 more people than the Republican half."

And they have the filibuster.

Let's all remember that the first impactful decision from the SCOTUS was... "Yo, we have final say on EVERYTHING!"

also (from the article):

Some scholars have questioned whether Marshall should have removed himself from the case because of his prior service as Adams's secretary of state (1800-01). Certainly, later judicial standards would have called for recusal [...]

Just gonna throw out a general recommendation for the play/movie "What the Constitution Means to Me."

It's a one-woman show (most of the time anyway) and it's really well done. It goes into a lot of the problems with being beholden to the constitution in the modern era.

I think the movie is still streaming on Prime.

Can't imagine why there's so much income to be taxed in New York
It's almost like, some kind of financial industry center is there
And money from other places just magically ends up there

Which is exactly why we shouldn't be bothered with exactly what the Founders intended, and should instead be concerned with applying the good principles that they wanted for themselves to everybody.  We've made some progress in the last 250 years, thank f*cking goodness.  Unfortunately some people are trying to push everybody else back off the pedestal, and they might succeed.

If we want to go with what the founding fathers "intended", then we should probably accept the fact they were forward-thinking enough to say that the entire U.S. Constitution should be replaced every so often to keep up with any future issues that may arise.

"Our Constitution is not good. It is a document designed to create a society of enduring white male dominance, hastily edited in the margins to allow for what basic political rights white men could be convinced to share. The Constitution is an imperfect work that urgently and consistently needs to be modified and reimagined to make good on its unrealized promises of justice and equality for all. And yet you rarely see liberals make the point that the Constitution is actually trash. Conservatives are out here acting like the Constitution was etched by divine flame upon stone tablets, when in reality it was scrawled out over a sweaty summer by people making deals with actual monsters who were trying to protect their rights to rape the humans they held in bondage. Why would I give a fark about the original public meaning of the words written by these men?"

That requires a degree of intellectual humility that many Republicans, including the former guy, are congenitally incapable of expressing. You can't even convince them that the broken glass sandwich they're eating is slicing up their mouth as they chew it and find their mouth pooling with blood.

There's a couple simple ways to fix that shiat. End "protest" votes by setting it up so voting no removes money. Split it up by House and Senate representation. Your House member votes no? Your district doesn't get that percentage of money. One, or both, senators vote no? Your state doesn't get that percentage of money.

Second: No state can get more money than it sent to the federal coffers. Suck it up buttercups and you had better get to work.

The Founders may have thought that. But they had enough base humility to understand that not everyone would ALWAYS think that; hence the reason they allowed for the Constitution to be amended, and why things like the 9th Amd. were thrown in there. Because they understood that things would change someday, indeed, were changing even when they wrote the damn thing.

The Founders were more liberal and forward-looking than their progeny who call themselves "originalists" and "textualists" today, and they'd rightly be horrified to hear someone like Alito talking about what the Constitution "meant."

Er.

I don't mind, in theory, that money from wealthy states are used to help out the poorer states.

Also, we had that until one of the amendments - income tax had to be apportioned to the states according to population (or something), which makes a national tax for national infrastructure kinda... Useless. And then the national infrastructure doesn't get built.

Could you imagine the "heartland" states having the money to pay for the national highway system? Or the type of conditions the interstates would be in?

There would be more holes than roads, which is convenient because that makes it hard to leave the state for an abortion, thus ensuring that all babies are born into hell.

What the "originalists" continually fail to recognize as well is that the Constitution is the *second* government of the United States. The original (Articles of Confederation) was quickly realized as so terribly broken that within a decade many of the same people responsible for it were back at the drawing board drafting the Constitution. They were all *very* familiar with the failings of the Articles when they drafted the Constitution and that knowledge directly influenced how they constructed the new government. The "originalists" like to conveniently forget that the Articles ever existed and instead are seeking to return to the "every state for itself" attitude it embodied when in fact our current form of government was created in direct response to the dumpster fire that attempt created.

This. We're either one country or we aren't. Shiat like elections should never have been left 'up to the states' (or at least that should have gone out the window the moment the farking telegraph took off), because having 50 different systems to select our government is farking insane.

Not necessarily. It'll only disappear if it gets in the way of the Republican agenda. For most of it, though, preventing Congress from acting on anything is perfectly acceptable, because the Republican agenda is purely destructive.

Oh, I'm fully confident that they know their "originalist" doctrine is a load of crap and nothing more than a convenient label they try to use to legitimize their regressive intents. They'll ditch any notion of originalism the moment it gets in the way of something they want.

Constitutional "Originalists" and Biblical "Literalists" have daddy issues. The constitution and the Bible were both written by imperfect men and are both riddled with archaic concepts. If you adhere to ideas espoused by those 18th century slave owners and 4th century preachers you are shackled to ignorance.
