Let's see, 250 years of being enslaved, a century of apartheid, and 50 years of hateful begrudging inclusion into democratic 'freedom'? Um, yeah. Affirmative Action isn't even the least we are obligated to do. Hell, jazz alone is worth a whole lot more than that.

Because for the many, many decades that the Supreme Court was exclusively white men that was never about race or gender.

I'm starting to think the foiks over at Fox News might be total dicks.

Pretty much, they miss that it's not their race and gender being the only qualification and want to take us back to that.

So what Geraldo is saying is that it is not possible to find a qualified black female jurist to fill the position?

Keep in mind that Geraldo's talk show was the precursor to Jerry Springer and other garbage TV programs.

Geraldo was/is so hated that when a damned KLANSMAN broke his nose, people basically shrugged & said, "Well, he is a bit of an ass so maybe he had it coming..."

Do you realize how much you have to catastrophically suck in order for the country to side with a KKK member who busted your face?

"They have one," replied Rivera, who is Puerto Rican from his father's side.
"Why not more, Geraldo?" Watters pressed.
"She is my favorite justice," he said, later adding that "she makes great rice and beans."

The process should be private and only the actual nominee should be publicly known.  I don't recall trump listing a bunch of black-out drunk rapists before settling on Kavanaugh.  Now the public will pick favorites based on the usual trivial reasons and whoever he decides on will cause a lot of people to get pissed off for no real reason at all.  And CNN will endlessly question of did he made the right decision, or unilaterally decide who he should have selected, asking if this is another "failure" of the administration.

Not that any of this matters, as Manchin and Sinema will have "issues" with the candidate because "reasons".  And Mitch will make sure the nominee doesn't get a single republican vote.  And in 2024 they'll figure out a way to impeach the new justice to remove them from the bench because a "true majority" did not vote for them.

You see, even though the standard conservative argument is that slaves were freed 200 years ago, and the Civil Rights Act was passed over 50 years ago so  affirmative action is completely unnecessary, there simply is not a single solitary black female in the country qualified the Supreme Court.

Nobody has said that only a white man is qualified. However when you come out and say we're going to pick a black woman you are ruling out everyone else based on race and gender and that is the very definition of discrimination. Is there any other job in the country where you can list right in the requirements that only somebody of a specific race is eligible and not be looking at a lawsuit? Maybe a black woman is the best possible choice but you shouldn't come right out and say you aren't considering anyone else if only because now she's going to be known as a diversity hire until the day she retires. That might have happened anyway but when Biden announces it he's left little room for doubt.

It's only different standards if you're holding the position that there are flatly no Black women in the United States who are qualified for the role.

Hard to say how this will shake out, but IMO just nominating a Black woman would have sent the message and fulfilled the promise loud and clear. By flatly saying this is a key selection criteria he's opening up his nominee to accusations that she's only being selected because of her race and gender. Not that the GOP wouldn't have tried that narrative anyway, but it makes their case really easy when Biden starts out saying the nominee will be selected based on their race and gender.

I have trouble believing that Gorsuch, Kavanaugh, and Barret were selected for being the most highly skilled judges available, rather than their political appeal to certain voter groups.

There are more races than black or white and I'm also expected to believe that there are more than two genders now as well. Why a black woman? Why not a Pacific islander transwoman? Sorry but they were out of the running at the start the job is only for a black woman.

Affirmative action is the process of making sure qualified people of different backgrounds than usual are hired. Conservatives make it seem like the process will pick anyone without qualifications from those groups. This is because historically whites have been promoted without qualifications at all and conservatives are dogshiat people defending their systems of control.
