Ya know, for the usual range of bullshiat that comes out of Rudy's piehole, I think this may be the least unbelievable.

Yeah, but I also have a hard time believing that there isn't a procedure in place to handle these situations. The only reason I'm not 100% positive is I don't know how much actual overlap there is between his case and trump's, where the actual documents requested (taxes, jan6 communications) were/are in someone else's hands already.

Rudy promises that once he gets the files back from the FBI,  Dominion is the very first people after the January 6th commission that he will share the files with.  He promises to share the files with them prior to handing it over to the NY Attorney's office criminally investigating the Trump Organization.

Keep in mind that withholding documents is how Alex Jones had a summary judgement against him in the lawsuit the Sandy Hook parents filed.

Any lawyers can comment on this.  Wouldn't it be that once Dominion proves Giuliani was lying, it becomes Giuliani's requirement to prove in the affirmative that he had reason to believe those lies were true?

Aren't those files more important to Rudy than Dominion - assuming his E-mails/documents had anything at all that convinced him the lies were true.

I find it a little suspect that a business, any business at all, operated for any length of time without any files. How would that business, for example, pay taxes?

It's probably good because he cannot destroy or alter any documentation.

I am sure the FBI will be happy to hand over copies (although might need intervention from a judge to happen)

Federal judge in Dominion case issues an order and subpoena to FBI to make an image of all of the seized hard drives and other items and hand them over to Dominion's attorneys (or to a special master). Problem solved, next case.

Yeah, that made me raise an eyebrow too.

There are devices that 'pretend' to have cloud access by using similar buzzwords, but are only putting the device online so that it can be reached.

That would not be truly 'cloud' though, just a buzzword for something that looks like it.

Perhaps that's what he MEANT?

If not, then there are 'cloud services' awaiting a subpoena or warrant right now.

I'm largely one of the Ain't Nothin' Gonna Happen folks Farkers hate so much, not because I want it that way -- 1,000% the OPPOSITE -- but because history has shown us pretty clearly that in most cases when power abuses power, Ain't Nothin' Gonna Happen. Trump will never see true justice.

HOWEVER, it's sure as hell looking like Rudy will, and it's a delight. He's going to die a disgraced wreck of a man, a total laughingstock with financial problems, zero credibility, and no one willing to touch him with a 10-foot pole. All signs point to this being his fate. He will end his days as a joke.

He's earned it, too.

It will be a rare case of Somethin' Happening and I couldn't be happier.

If the FBI went bad under Trump, the probably seized Giuliano's stuff to prevent the courts or the 1/6 commission from getting any of it.

Barr directed them to take Rudy's stuff to cover things up.

The lack of a back-up is intentional. You don't take notes on a criminal conspiracy and then make copies. Rudy's sloppy and lazy in his dottage, but this is on purpose.

The FBI can provide copies of the HD images. Pretty simple to ingest and review docs once you have copies of the images.

The onus is on Dominion to prove that Guiliani knew his defamatory statements were false and that he uttered them with malice towards them (assuming a company is a "public figure"), which is difficult to prove.  If his communications prove that he knew it was a false narrative, was likely to harm Dominion monetarily, and he continued to do so, it's a slam dunk for Dominion.

IANAL, but I suspect that the FBI having the files wouldn't be an impediment to getting them, as Dominion could subpoena the FBI for copies.

But our legal system is byzantine and complex, so I'd like to hear from a lawyer whether that's how it would actually work or not IRL.
