Oh. I'm not worried. John Roberts and all the judges will be along shortly to tell us how not partisan they are.

Just as soon as they get back from CPAC

This was always McConnell's game. You can lose elections, but judges last a lifetime.

But for SCOTUS, Republicans need to win enough so that the president and the Senate can't expand the court. Shouldn't be too hard with the Senate being skewed hard towards low population deep red states, but they still have to win elections.

And that's how you get civil wars, dictators, etc.

With a Supreme Court majority and two red Democrats - basically they're choking the entire country with only five people.  Assholes.

I have more faith in a Pelican's Brief come to life, than congress being functional again.

From an outsider perspective - your SCOTUS will be illegitimate as a legal authority until two, possibly three justices have been impeached and removed from the bench.

But they're going to do it anyway. Partial power isn't enough.

If you really want to go after these people then you should go after their financial backers first. The people writing the checks to their campaigns and superpacs. Till those people are out of the picture things will never change cause they'll just slap another in to replace the political figure you voted out/impeached.

2022-01-25 9:15:12 AM
Not Really.  Congress has enormous power over the Supreme Court written right into Article III of the Constitution, and with a simple majority vote can forbid the supreme court to hear any case or type of case they wish:

In all the other Cases before mentioned, the supreme Court shall have appellate Jurisdiction, both as to Law and Fact, with such Exceptions, and under such Regulations as the Congress shall make.

2022-01-25 9:15:14 AM
And the Republicans are learning that once a judge is appointed there is no guarantee that the judge will always decide cases favorably to the party.  Up next: Purity tests for judges

An entirely predictable and predicted outcome.

For years the GOP knew this was the goal...and got it to be a huge issue with republican voters.

For years the democrats ignored the threat, and never really made it an issue for voters  beyond a few talking points.

Now we all pay the price.

Didn't Biden's little committee come back and say that they should add 4 more justices to the SCOTUS?

There is no way that 9 people should have that much power over 330,000,000 people. No matter what, the SCOTUS needs to be expanded and they need to have term limits, age limits (as should all of Congress) and they should be able to be removed from their position (as should Congress) easier than they currently can be.

2022-01-25 9:16:16 AM
Don't grow the court or you'll undermine their legitimacy!
Also OSHA doesn't have the authority to enforce workplace safety and states don't have to let people vote

Whomever wrote this doesn't understand the nature of power.

How much power they acquire will never be enough. Need is irrelevant. They will continue to consolidate power long after it becomes absolute, because accumulation of power is an end in itself.

They will continue to do so until they are stopped. Not one second before.

It's been going on 50 years. Not many government institutions have any credibility left, including now the USPS. And we had a violent insurrection, which goes to prove the point. Incompetent government leads to instability which is right where we are now. On the brink of civil war and dictatorship.

Yes, lets blame a person with a lifetime appointment for....serving for her lifetime? FOH. She only did what she was entitled to do under the rules that were set up long before she ever arrived. Thats like saying to someone who worked for a company for 50 years during his retirement party, uh dude, if you woulda retired 10 years ago we could saved the company some money...

No, if you insist on not wanting to do anything of substance to help remedy the situation such as writing letters, calling you lawmakers, organizing or going to protests, or supporting candidates that adhere to your values, and all you want to do it look back and find who to blame, it falls solely on every individual who showed up to the voting both in 2016 and did not vote for Clinton cause she didn't "inspire" them or had buttery emails. Full stop.

Trump is an illegitimate President put in power by a foreign enemy. His Supreme Court choices should be nullified, and Barrett and Kavanaugh should be removed from the bench. Clarence Thomas should be removed from the bench because he is part of the insurrection.

Biden could fix this today by stacking the court, but he won't, because "reasons"

What's that you say? It would create an arms race and the NEXT guy would stack the court? Good, if the system is broken then either fix it or break it so it requires fixing. Half this country is in a cold war with the other half who aren't aware that they really want them dead.

Oh, all we need to do is "fix it".  Why didn't you just say so?  As always, the devil is in the details.  How do we go about fixing it?  As the last century has showed us time and time again, when the system breaks down, the chief executive will simply rule by fiat.

A lot of counter arguments are predicated on the idea that the majority of Americans, especially those that live in urban areas, will quietly cow tow to what will essentially be a Taliban-ish takeover of the country.

Understood, given American's laziness and apathy thus far in the far-right putsch that one would assume will simply roll over as long as they have entertainment.

But the stuff that drains our time isn't just the distraction of the tv, it's longer work hours, it's trying to maintain relationships remotely during a pandemic and it's making ends meet.

Conservatives don't just want to control the majority of Americans that disagree with them.  They want them to agree.  They want them to convert and see the "truth."

Conservatives can't shut up and won't stop until everybody thinks and acts exactly like them.  As lazy as Americans are, they are not going to give up drinking, or sex, or drugs, or porn or music or television it's still very hard to see a scenario where conservatives are allowed to dominate the rest of us.

Well, for instance, things like ethics violations should be able to be removed by a simple majority vote (in both houses). People like MTG that are now worthless in Congress should be able to be removed by a simple majority (in both houses). I realize this could be volatile at first, but since the ethics committee is pretty reliable in not being partisan hacks that would help mitigate issues, and most people don't go flat-out QAnon crazy like MTG.

People like Thomas should be able to be removed from the bench for all the times he failed to recuse himself and had a conflict of interest. Perhaps set up a nonpartisan board to review such issues like that, and make it possible to remove them from the bench.

Then again, this is also Fark, if I had all the answers I wouldn't be posting here. I'd be living in a huge mansion with my Mila Kunis, Kate Upton, Anna Kendrick girlfriends, drinking champagne in my hot tub.
