As someone who was born in the Balkans I feel it's my responsibility to try and redeem the reputation of both himself and Serbia as a whole which Novak has tarnished and pulled down into the abyss with his inane antics.

Honestly, between him, Aaron Rodgers, and Letitia Wright, I'm at a loss over which person's acts of stupidity annoy me more.  I get being rich and stupid, but even some of them know not to jeopardize their ticket.

I've pointed it out in previous threads but just worth repeating for those not au fait with Australia's immigration laws, this case is about Novaxx's visa being cancelled by the immigration minister on Friday. It's not an appeal of the earlier departmental decision to can the visa which was then overturned on judicial review last week. It's a separate process and one stacked heavily in favour of the government, because the immigration legislation grants a LOT of power to the minister in cases like this.

If Novaxx wins it will be a pretty spectacular outcome and a massive, massive kick in the 'nads to the Australian government. They're not the most competent government we've ever had by a very long margin, but as long as they've got their case lined up even basically well they really can't lose, such is the power the minister has by law.

The Australian public are generally supportive of kicking Novaxx out, I know I certainly am, but procedurally this has been quite the clusterfark. Nobody's coming out of this looking too clever, and heads are going to roll at Tennis Australia I'm guessing. If the minster automatically applies the three year ban on Novaxx entering Australia (which is the normal state of affairs when the minister cancels a visa) that will lead to a lot of international criticism I'm guessing.

We have no pit big enough for a single animal of each deadly species let alone the lot. But i hear there is a volcano we can now use...

I liken it to coach's challenge/video review in football games.

The ruling on the field is what is challenged. The challenge is to overturn it. If the review is not 100% conclusive, then the ruling on the field is upheld -- even if it was made in error. Basically, everything defaults to the referee's original call if the video review cannot beyond a reasonable doubt overturn it.

So the challenge isn't to argue a different ruling or change the call to something else, it's to overturn the one that exists on the field now.

So yeah: The Minister is the referee who made the call yesterday. The reason why he made the call he did (that Novak was a threat to public health/safety/etc.) is because those are not concrete, objective criteria that can be easily overturned. They are fairly subjective and while it might be possible to come up with a solid counter-argument, it's not so easy to do it in 24 hours.

It's a serious problem for Djokovic's lawyers now to prove 100% conclusively that Novak is not those things, and that's difficult to do given the complete shiat show of the past week.

It is definitely stacked pro-gov anyhow, but the easiest support the government has to the statement is how Djoker acts when he has covid. The fact that he doesn't quarantine and was previously a spreader at that 2020 event he ran helps gov case. Mind you, he can afford the best possible layers to win on any technically.

If he loses though, I don't think they bar him for multiple years, they'll want the redemption promos and coverage for the 2023 Open.

The French Open has already said he'll be welcomed there. Wimbledon will probably welcome him too.

The US Open? If NYC doesn't change its policies for unvaxxed people (see Kyrie Irving in the NBA) before August, he probably won't be playing there.

I guess I'm still kind of wonder if somehow Djoker will win again so not really getting my hopes up for an extended ban. Plus a 2023 govt could look different than 2022 so who knows what type of thing would happen. I mean I hate the whole "they're here to redeem themselves from an ahole past BY WINNING storyline, but damn if that won't be top news on ESPN if he's in next year's tournament"

There's a federal election due by May, but even if the government does change the new one isn't going to go much easier on foreign visa applicants.  Especially not vaxx-dodging tall poppies who appear to have gotten special treatment because they're wealthy.
