I was under the impression that downloading files makes a copy of them on whatever device they are being downloaded to. So if you browse a Fark thread on your personal computer the inline images would be copied to that storage device and those copies would thus be in your 'possession.'

I'm confused. Which is usually my natural state, but if google tipped off the police, then google must've known about the child porn images, correct? If so, why are they still leaving that site open so that people can do that crappy shiat? I thought they were trying to be better guardians of the Google search engine.

I am not an attorney but I am reasonably certain that "just downloading something" has counted as possession for quite some time now.

You assume that Google had foreknowledge of the site content from which the images were acquired.

Consider this scenario:
Fark headline subject searches for images of that nature using rather obvious search terms and finds a website hosting it.
Google later does a sweep for sites to omit from search results and comes across that aforementioned website.
Google also finds that the aforementioned Fark headline subject clicked through to that site from a Google search after searching on rather obvious search terms.

Another possibility is that simply using certain search terms triggered an investigation by Google who, after finding the site content (and that the subject clicked on the site through Google search results), contacted law enforcement.  In either case, Google would not have known about the site and its content until after the subject had accessed it.

Technically, yes, but mens rea (intent) is still a necessary component to prosecution.

Say I were to hypothetically post a particularly foul image in this thread and then moments later you get a knock at the door and it's Chris Hansen and his television crew.  You have the positive defense that you had no intention of accessing that image. You have even more of a defense if you reported it to the moderators.

Honeypots are also usually built to keep innocent people out - there must be some level of demonstrable intent to get into one.

It's pretty unlikely that this is a case were the dude was pranked into clicking a link on 4chan, or enjoying "barely legal 18 year olds" and it turns out they were actually 17. He had to want some nasty stuff and work to get it.

Turbo Cojones: Are we at the point yet where just d/l ing something counts as possessing it?

Yeah, we are. But Google offering it for download isn't.

A website can literally bury child pornography by loading pictures to be staged for later reveal, but the reveal part can be left out of the code. You visit the site, your browser downloads all the images to cache for easy loading, boom, you're in possession.  So you don't see, or even KNOW you've got it for you to be busted for possession of it.

You will then be fighting an uphill battle to prove you didn't mean to or ever saw it in legal court while the court of public opinion has already gotten you fired from your job that funds the lawyer defending you of it.

Meanwhile, Google (and all the others) can dig it out of the website metadata and legally offer it for... illegal viewing, somehow.

It's nuts and congress is beyond fixing any of this because of the hot mess we're dealing with right now.

It doesn't take much to get people in trouble for things like this by lying and deception and it takes every bit of one's strength and resource to overcome a charge like that. And you still get stigmatized even if you didn't do anything at all.
