Step 2 after legalization:
Be courteous to the neighbors. Keep the same rules like it's illegal - no smoking in the hallway, and if it's a no smoking rental in general, no smoking in the rental.

There are some cities that prohibit landlords from leasing out residential spaces to commercial tenants. I'm kinda surprised that NYC isn't among them.
