I mean, on one hand, that's a bit silly on the surface.
But, it's not like it's as clearly ridiculous as a trademark in an unrelated industry. A trademark must be actively defended or they open themselves up to challenges/abandonment.

The only winner will be whoever gets the order to re-print their business cards and stationary...

That's why I don't have high hopes for KSP 2. Squad will not be hamstrung by the inherent limitations of the Unity engine, but will instead be hamstrung by a shiat publisher.

That's a shame. I watched a fun stream of Dunkey and Leah playing It Takes Two. It looked like a cute game. Like the premise to a Disney movie come to life, but with snappier dialogue and somewhat more heavily armed protagonists.

I think I bought a couple of games he published in the '80s. Decent games. I don't know if the creators of those games ever received the royalties they were due. Maybe I had pirated copies. If the creators of those games weren't paid then I hope I did.

And this is why "Fark Kotaku" comes to mind:

The reason companies make moves like this is essentially to future-proof their own rights. If Take-Two decided it wanted to do a whole advertising campaign around "It Takes Two," for instance, at that point EA or Hazelight could enforce their own trademark to prevent this. By forcing them to abandon it now, Take-Two needn't worry. But wow, it still sucks, especially when overreaching like this.

The person who wrote the article knows, full well, that Take-Two has no damned choice in the matter - copyrights must be actively defended, because you can actually lose a copyright through passivity. But, they decided that it's OK to be angry because it doesn't feel right.

They're not "overreaching," and they're doing exactly what they have to do in the Age of Intellectual Property. But, Kotaku wants to stir some shiat so they're happy to gin up the outrage in the first half of the friggin' article, then drop in the "sure, it's what Take-Two's supposed to do, but WAHHHHH!" bullshiat afterwards.

Exactly - the point of active defense is that it allows the copyright or trademark to be examined and the boundaries of it determined by the courts. Take-Two may well lose the case, but even a loss confirms their active defense of the trademark - not taking any action, or providing an informal agreement, could be disastrous for them in the future.
