I have.

Contrariwise, even if "politically explosive" reaches the literal level of "car bomb in Kavanaugh's car", the anti-Choice right seem unlikely to care to any degree beyond adopting such tactics themselves. Reversal of a ruling to overturn Casey and Roe would probably require something more outré, on the lines of at least three anti-choice justices be torn limb from limb by a mob of pregnant women.

Nohow, I could be wrong about that.

Refusing to expand the judiciary was worth it. I rest easier knowing the Democratic committee for judicial reform came back and said everything was hunky-dory and just fine as it is.

Kavanaugh's questioning was all centered around the thesis that abortion being illegal or illegal on the federal level are both radical positions and that he is being a moderate and splitting the baby fairly by removing Roe v. Wade to make the courts apolitical on the issue. That the arc of history bends towards justice and as such the Supreme Court revisiting previous rulings on civil rights to change them has been heralded in the past and should continue to be as progress in this case.

Give the New York Times 6 months and they will come around to "this has been a consistent and moderate position for the courts to take."

I think the reason that the newspapers are writing all the panicked articles is that a couple of the justices were asking quetion about the legitimacy of the court and public opinion; about social change and the need to be responsive; about that very same principle creating a paradox for ruling on Dobbs. The MS side had no principled answer to that problem. The pro-choice side had a couple of principled answers. The newspapers are trying to create sense of the public's pro-choice response to the potentially illegitimate court (since we all know how the GOP side presents the tenuous legitimacy of the court). The line of questioning, of course, means the justices are also aware of the possible revolutionary tipping point Dobbs is designed to be if the court rejects the MS arguments.

TFG failing to get impeached either of his 2 times was proof positive that America has no systems in place to remove bad actors from office in any tangible method except in name on.

It's the same as saying "We have a system in place to punish people who commit criminal activity.  It involves the oldest man in the county moving a 100 lb bolder up a hill 100 meters, and the criminal moving a 1 lb rock across the table, if they succeed before the old man they can go free."

Sure, that's a "system" of punishments I guess, with an impossible series of standards that will fall the same way every time. But let's lie to ourselves and pretend it does the job it's suppose to do.

It will be "politically explosive" in the sense that the majority of Americans -- including a small majority of Republicans -- believe Roe should be preserved, and overturning it will delegitimize the court and cause it to be viewed once and for all for the panel of unelected political hacks it actually is.

Republicans won't care.

It feels like we all are living in an age of kayfabe, when journalists have to pretend that Kavanaugh being even further shown to be a liar is somehow "politically explosive" and Very Serious People will have Very Serious Concerns.

I don't know if people just don't want to admit what is happening in our country, or they're hoping that we'll all fool ourselves, creating a human ouroboros of blindness.

Once one nakedly partisan decision is handed down, there is no way to assume that the rest of them aren't nakedly partisan as well and it'll be game over. He doesn't even have to lie, exactly.

I heard an excerpt of his remarks and it seems his solution is for the court to "take neither side" and allow states to decide for themselves. He added it was an issue that could be addressed by Congress.

It's not a lie that you believe Roe is settled law, nor do you have to take a stance, if you just throw up your hands and say "it's up to the states and, preferably, Congress"

He's a slimy weasel.

I've been told that once the judiciary is poisoned the steps left to cross into banana republic land are nearly at an end. Once they're used to jail political opponents, it's pretty much over.

If Beer Bro could defer to, oh, say, Texas being the arbiter of "state's reproductive rights" and Texas jailed providers, well, we're right there for all it matters and Kavanaugh maintains his "who me? gosh, no!" facade.
