But, please find me a prosecutor who wouldn't store a case away in a draw and bring it out anytime they wanted something to hold over the accused where there are unreliable memories/evidence that a defense could not contest/refute.

In a world where the state can prosecute any case no matter how old that case may be is called an oppressive society.  This is a basic legal underpinning in Western legal systems.  The state shouldn't have an unlimited amount time to prosecute except in the most extreme cases of capital crimes such as murder.  They teach this in law school.  Any lawyer that doesn't get and believe in this concept should think about becoming a talk show host.
